A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JACINTO, CALIFORNIA, AUTHORIZING THE
PURCHASE AND SUBSEQUENT USE OF A NOW
LETHAL WEAPONRY SYSTEM WITHIN THE SAN
JACINTO POLICE DEPARTMENT.
WHEREAS, Police Officers are involved, on a daily basis, in numerous and
varied human encounters and, when warranted, they must use force in carrying out their
duties, and
WHEREAS, Police Officers, in exercising the duty to use force, need to have a
range of force options available to them, so they may effectuate an arrest while using a
reasonable and effective level of force; and
WHEREAS, the non-lethal Pepperball oleoresin capsicum [OC] launcher offers
an effective tool in the use of force continuum, while maintaining officer safety, and
WHEREAS, the product known as "Pepperball" is proprietary in nature and can
be obtained only from Jaycor Tactical Systems, Inc. Further, no equivalent product is
known to be available. Therefore, this council hereby declares the Pepperball OC
launcher system is a proprietary product, available only from the sole source provider
Jaycor Tactical, Incorporated and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San
Jacinto, California, the purchase and subsequent deployment of the Pepperball OC
launcher, with related equipment and supplies, is hereby approved;
BE IT FURTHER RESOLVED, that the purchase price of ten [10] Pepperball OC
Launchers, supplies, and related equipment is approved, in the amount of $8,339.12
and shall be appropriated from funds derived from the AB 3229 California COPS grant,
Fund 64.
Approved and adopted this 7th day of March, 2002 by a 510 vote.
