COUNTY OF RiVERSIDE)ss
CITY OF SAN JACINTO )
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO,
CALIFORNIA, APPROVING AN AMENDMENT TO THE LAND USE ELEMENT
OF THE GENERAL PLAN FROM LOW DENSITY, MEDIUM DENSITY AND
HIGH DENSITY RESIDENTIAL, PUBLIC INSTITUTION, COMMUN-ITY
COMMERCIAL AND LIGHT INDUSTRIAL TO RURAL RESIDENTIAL, LOW
DENSITY RESI-DENTIAL AND LIGHT INDUSTRIAL ON CERTAIN
PROPERTIES AS SPECIFIED HEREIN: FILE NO. PRE-ZONE NO. 2-01.
WHEREAS, local governments are authorized by Government Code
section 65350 et seg., to prepare, adopt and amend general plans; and
WHEREAS, the proposed amendment to the Land Use element of the
City of San Jacinto General Plan ("Amendment") initiated and prepared by the
City of San Jacinto for the area generally bounded by the San Jacinto River on
the north, Record Road on the south, State Street (SH-79) on the east and
Sanderson Avenue on the west ("Subject Site") to Rural Residential, Low
Density Residential and Industrial, implements the overall policies and goals of
the General Plan and leaves the General Plan internally consistent; and
WHEREAS, the proposed Amendment was not sent to affected public
entities for their review and comment; and
WHEREAS, the Amendment was reviewed, studied, and found to comply
with the California Environmental Quality Act ("CEQA") as more fully described
below; and
WHEREAS, on December 12, 2001, the Planning Commission of the City
of San Jacinto ("Planning Commission") conducted a duly noticed public hearing
on the Amendment at which time all persons wishing to testify in connection with
the Amendment were heard and the Amendment was fully studied; and
WHEREAS, on January 17, 2002, the City Council of the City of San
Jacinto ("Council') conducted a duly noticed public hearing on the Application at
which time all persons wishing to testify in connection with the Application were
heard and the Application was comprehensively reviewed; and
WHEREAS, all other legal prerequisites to the adoption of this Resolution
have occurred.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SAN JACINTO:
SECTION 1. Based on the entire record before the Planning Commission,
all written and oral evidence presented, and the findings made in this Resolution,
the Planning Commission of the City of San Jacinto has recommended the City
Council approve the Amendment to the General Plan as set forth in the attached
Exhibit "A" graphic.
SECTION 2. Based on the entire record before the City Council and all
written and oral evidence presented, the City Council finds the Amendment
promotes the goals and objectives of the General Plan and leaves the General
Plan a compatible, integrated, and internally consistent statement of policies for
the following reasons:
A. The Amendment is integrated and compatible with the Land
Use Element in that it provides an appropriate orientation and
relationship between land uses within and adjacent to the Subject
Site, and promotes orderly development beyond the Subject Site's
boundaries because the industrial land use is compatible to other
industrial uses proposed to the south, and the planned residential
uses are compatible with residential uses to the south. It
recognizes the existence of the Agricultural Preserve and
establishes land use categories that allow agricultural uses to
continue. The whole of the area is isolated from land uses to the
north by the San Jacinto River and its planned levee.
B. The Amendment is integrated and compatible with the
Circulation Element in that the density and distribution of uses
within the Subject Site will generate traffic that is anticipated and
provided for in the Circulation Element because the site is bounded
by State Street (SH 79) on the east, Sanderson Avenue on the
west, and Record road on the south. It will also be served by the
extension of Potter Road from the south. Additional internal
circulation elements will be considered as development projects are
proposed.
C. The Amendment is integrated and compatible with the
Housing Element in that it provides for development consistent with
the existing and projected housing needs of the community and
region because it implements the Housing Element Policy of
"...providing a variety of housing opportunities by type, tenure, and
cost to households throughout the City" by providing for two low
density development areas in this area of the City not previously
available
D. The Amendment is integrated and compatible with the
Conservation Element in that it provides uses which promote the
orderly conservation, development, and utilization of natural
resources because it allows existing agricultural uses to continue at
the discretion of the landowners in recognition of the Agricultural
Preserve status of a portion of the site.
E. The Amendment is compatible with the Open Space
Element in that it provides for uses that are not inconsistent with the
adopted goals and policies for preserving and managing open
space within the City and do not create conflicts to the realization of
said goals and policies.
F. The Amendment is integrated and compatible with the Noise
Element in that it provides a pattern of land uses that minimizes the
exposure of community residents to excessive noise because the
proposal utilizes streets and natural barriers to separate land used
and minimize noise exposure from adjacent land uses.
G. The Amendment is integrated and compatible with the
Safety Element in that it provides an appropriate land use
distribution and orientation which protects the community from
unreasonable risks associated with seismic, geologic, flood, and
"~ wildfire hazards because this General Plan Amendment and the
associated Pre-Zoning are precedents to applying for annexation of
an area which will allow the City to pursue the development of a
levee along the San Jacinto River to protect the adjacent properties
and the community at large.
SECTION 3. Based on the entire record before the City Council and all
written and oral evidence presented, the City Council finds the Amendment
complies with CEQA for the following reasons:
An environmental initial study has been conducted which has
determined that there could not be a significant effect on the
environment. Therefore, adoption of a Negative Declaration is
recommended.
SECTION 4. The location and custodian of the documents and any other
material which constitute the record of proceedings upon which the Planning
Commission based its decision is as follows: Planning Director, City of San
Jacinto Planning Department, 248 E. Main Street, San Jacinto, CA 92583. (909)
487-7330.
SECTION 5. Effective Date. This Resolution shall become effective upon
"`" its adoption.
PASSED, APPROVED AND ADOPTED, this 17th day of January 2002.
