COUNTY OF RIVERSIDE)ss
CITY OF SAN JACINTO )
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JACINTO, CALIFORNIA APPROVING TENTATIVE TRACT MAP 37229
(THE BUNGALOWS AT MOUNTAIN BRIDGE), SUBDIVIDING 10.4
ACRES INTO 73 SINGLE FAMILY RESIDENTIAL LOTS LOCATED AT
THE SOUTHEAST CORNER OF ESPLANADE AVENUE AND HEWITT
STREET (439-180-015).
WHEREAS, Bill Lo, WMR Holdings, LLC fled applications on January 10, 2017,
January 11, 2017, April 11, 2017, and May 17, 2017, for Tentative Tract Map 37229
(The Bungalows at Mountain Bridge) to subdivide 10.4 acres into 73 single family
residential lots ("Application"), located at the southeast corner of Esplanade Avenue and
Hewitt Street ("Subject Site"), and more particularly described in Attachment "A"
("Tentative Map');
WHEREAS, the Subject Site is proposed for a change of Zone from CN —
Commercial Neighborhood to RM-RSJSP — Residential, Medium Density— Rancho San
Jacinto Specific Plan (5.1 to 10.5 du/ac);
WHEREAS, the Application was reviewed, studied, and found to comply with the
California Environmental Quality act ("CEQA") as more fully described below:
WHEREAS, on December 11, 2017, the Planning Commission of the City of San
Jacinto ("Planning Commission") conducted a duly noticed public hearing on the
Application, at which time all persons wishing to testify in connection with the
Application were heard and the Application was comprehensively reviewed, and the
project was recommended for approval by the City Council; and
WHEREAS, on January 16, 2018, the City Council the City of San Jacinto
conducted a duly noticed public hearing on the Application at which time all persons
wishing to testify in connection with the Application were heard and the Application was
comprehensively reviewed by the City Council; and
WHEREAS, all other legal prerequisites to the adoption of this Resolution have
occurred.
NOW, THEREFORE, BE IT RESOLVED, ordered and determined by the City
Council of the City of San Jacinto:
SECTION 1. Based on the entire record before the City Council, all written and
oral evidence presented, the recommendation of the Planning Commission and the
findings made in this Resolution, the City Council hereby approves Tentative Tract Map
37229, subject to the conditions of approval in the staff report.
SECTION 2. Based on the entire record before the City Council and all written
and oral evidence presented, the City Council finds the Application:
A. The proposed subdivision implements the proposed General Plan (GPA-17-01)
and Specific Plan (SP-01-88/SP-02-88 Amendment #6) amendments which
creates internal consistency with the General Plan and the Specific Plan. The
Project will further the intent of the General Plan by facilitating in-fill development
while addressing the City's housing needs and by meeting the following General
Plan goals and policies:
LU Policy 1.2: Create housing opportunities that match employment
opportunities within the community.
LU Policy 2.2: Encourage infill development to be consistent with and
complement the bulk, scale, intensity, and character of the existing surroundings.
LU Policy 4.1: Evaluate the compatibility of new development with
surrounding uses when reviewing development proposals and designing the
circulation system improvements.
LU Policy 4.2: Ensure that new development is compatible with the physical
characteristics of the site, surrounding land uses, and available public
infrastructure.
HE Policy 2.1: Provide adequate sites for a range of new housing
construction to meet the Regional Housing Need Assessment (RHNA) for San
Jacinto of 12,026 units in the 2006-2014 planning period.
The proposal continues the land use pattern proposed under the Rancho San
Jacinto Specific Plan ("RSJSP") consisting of higher density residential
development toward the urban center of the City (western portion of the Specific
Plan area) with the lower density residential development toward the periphery of
the Specific Plan. Ample opportunities exist in the surrounding area for
commercial development and this site is well suited for residential development.
B. The RSJSP laid out the higher density residential development toward the urban
center of the City (western portion of the Speck Plan area) with the lower
density residential development toward the periphery of the Specific Plan. The
proposed MDR-RSJSP — Medium Density Residential — Rancho San Jacinto
Specific Plan land use designation will be consistent with the development
pattern of the Specific Plan and the surrounding area. There is considerable,
vacant, commercial land to the west of the Specific Plan boundaries providing the
needed shopping opportunities for the residential development in the area.
C. Adequate City infrastructure exists to support the Project and the Project has
been reviewed by Police, Fire, and Engineering to ensure that the design
accommodates public and emergency vehicles including solid waste haulers,
City crews, and other service providers.
D. As noted in "A" above, the subdivision is designed for consistency with
surrounding development in terms of both design and density. With the
application of the Planned Development Permit (PDP) on the subdivision,
efficient use of the land and better living environments with high standards of
quality and amenities will be created.
E. An initial Study was prepared for the Project to determine the Project's potential
to result in significant environmental impacts. The Initial Study determined,
based upon substantial evidence, that with the incorporation of identified
mitigation measures, no significant impact would occur as a result of the Project.
The mitigation measures required to reduce or mitigate the impacts of this
Project on the environment are included in the Project design and/or the
Mitigation Monitoring Program and have been made enforceable Conditions of
Approval for the Project.
F. The proposed General Plan (GPA-17-01) and Rancho San Jacinto Speck Plan
(RSJSP) (SP-01-881SP-02-88 Amendment #6) amendment to change the
commercial designation on the Subject Site to residential medium will facilitate
single-family residential development that has been well designed for
compatibility with the surrounding area. The implementation of the proposed
conditions will ensure that the Project will not be detrimental to the public interest,
health, safety, convenience, or welfare of the City.
G. The proposed subdivision as designed and conditioned will not conflict with
existing easements. In fact, as noted in the Initial Study prepared for the Project,
the Project corrects an issue with a private sewer line for the property to the east
of TTM-37229 which was not located within an easement or accepted by the City
in the past (See Utilities and Service Systems in the Initial Study).
SECTION 3. Based on the entire record before the City Council and all written
and oral evidence presented, the City Council finds the Application complies with CEQA
for the following reasons:
An environmental analysis has been conducted which evaluated information and
impacts based on the specks of this proposed project. This analysis
determined that, although the proposed project could have a significant effect on
the environment, there will not be a significant effect in this case because
revisions in the project have been made by or agreed to by the project proponent
and other effects will be mitigated to a level of less than significant impact.
Therefore, a Mitigated Negative Declaration and its associated Mitigation
Monitoring Plan is recommended.
The City Council finds that pursuant to State CEQA Guidelines section 15074.1.
Mitigation Measure TRAF-1 is equivalent to Mitigation Measures TRAF-2 through
TRAF-5 in mitigating the Project's impacts relating to traffic and circulation.
Specifically, implementation of TRAF-1 will avoid or reduce the potential impacts
at issue to a level of less than significant. As such, the Council finds that deleting
Mitigation Measures TRAF-2 through TRAF-5 will not cause any potentially
significant effect on the environment.
SECTION 4. The location and custodian of the documents and any other
material which constitute the record of proceedings upon which the City Council based
its decision is as follows: Planning Director, City of San Jacinto Planning Department,
248 E. Main Street, San Jacinto, CA 92583. (909) 487-7330.
SECTION 7. Effective Date. This Resolution shall become effective upon its
adoption.
