COUNTY OF RIVERSIDE ) ss
CITY OF SAN JACINTO
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JACINTO, CALIFORNIA GRANTING AN
ADDITIONAL TIME EXTENSION TO CONDITIONAL USE
PERMIT, TEMPORARY CONDITIONAL USE PERMIT,
AND SITE PLAN AND DESIGN REVIEW (STAFF
REVIEW) APPROVALS WHICH ARE DUE TO EXPIRE ON
OR BEFORE APRIL 19, 2016, AND MAKING FINDINGS IN
SUPPORT THEREOF
WHEREAS, existing City regulations establish, pursuant to the San
Jacinto Zoning Ordinances, a regulatory framework for controlling the development and
use of land, which in some cases require a developer to submit and have approved by
the City a Conditional Use Permit, Temporary Conditional Use Permit, or Site Plan and
Design Review (Staff Review) approval (collectively, "Discretionary Entitlements"). City
regulations further provide for the expiration of Discretionary Entitlements after an initial
two (2) year term with two (2) additional one (1) year extension terms granted at the
Planning Director's and City Planning Commission's discretion, respectively; and
WHEREAS, on April 11, 2011, City Council approved Resolution No. 3374
granting an automatic two (2) year term extension to all active discretionary
entitlements, which were active and due to expire on or before April 19, 2012; and
WHEREAS, on March 4, 2014, City Council approved Resolution No.
3374 granting an automatic two (2) year term extension to all active discretionary
entitlements, which were active and due to expire on or before April 19, 2015; and
WHEREAS, even with the automatic two (2) year term extension, the City
continues to experience a slow recovery in the economy, and developers and land and
business owners face the prospect of having their Discretionary Entitlement approvals
expire before they can obtain financing or have their projects make any sort of
economic sense to build; and
WHEREAS, the proposed measure is necessary to support the future
economic recovery of the City. Over the past few years, the building industry has been
mired slow recovery and, because of the difficulty of securing financing, many projects
for which Discretionary Entitlements have already been approved, will expire within the
next year, thereby requiring developers to go through the entitlement process again, if a
time extension is not granted; and
WHEREAS, the building industry wants to be in a position to take full
advantage of any economic resurgence; and
Page 1 of 4
WHEREAS, this measure is proposed in order to spare developers, land
owners, and business owners within the City the added time and expense of obtaining
new approvals when the economic picture brightens in the future; and
WHEREAS, the activity is not a project as defined in Section 15378 of the
California Environmental Quality Act ("CEQA") Guidelines, California Code of
Regulations Title 14, Chapter 3 ("CEQA Guidelines"); and
WHEREAS, all other legal prerequisites to the adoption of this Resolution
have occurred.
NOW, THEREFORE, BE IT RESOLVED, ordered, and determined by the
City Council of the City of San Jacinto:
SECTION 1. The City Council finds that this Resolution is not subject to
CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines because it can be seen
with certainty that there is no possibility that the activity set forth in this Resolution may
have a significant effect on the environment and Section 15060(c)(3) of the CEQA
Guidelines because the activity is not a project as defined in Section 15378 of the
CEQA Guidelines.
SECTION 2. Based upon the substantial evidence presented to the City
Council, the City Council concludes that:
A. The proposed measure is necessary to the support of the future
economic recovery of the City, as the building industry has been hindered by recession,
followed by a slow economic recovery, and because of the difficulty of securing
financing, many projects for which Discretionary Entitlements have already been
approved will soon expire, thereby requiring developers to go through the entitlement
process again, if a time extension is not granted; and
B. The proposed measure will spare developers, land owners and
business owners within the City the added time and expense of obtaining new
approvals when the future economic picture brightens, thereby aiding the City in its
economic recovery.
SECTION 3. Based upon the findings and conclusions in Section 2, the
City Council hereby grants an additional two (2) year time extension to all active
Discretionary Entitlements, which are due to expire on or before April 19, 2016.
SECTION 4. Effective Date. This Resolution shall become effective upon
its adoption.
