A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SAN JACINTO, CALIFORNIA, APPROVING
CONDITIONAL USE PERMIT NO.15-5 TO ESTABLISH A
SATELITE KINDERGARTEN FOR SAN JACINTO VALLEY
ACADEMY AT 719 EAST MAIN STREET
WHEREAS, San Jacinto Valley Academy filed an application on
September 15, 2015, for a Conditional Use Permit to establish a satellite Kindergarten
for San Jacinto Valley Academy ("Application"), located at the Community of Christ
Church, 719 East Main Street. ("Subject Site");
WHEREAS, the property affected by the Application is within the
Commercial Neighborhood Zone (CN) zoning district;
WHEREAS, the Application was reviewed, studied, and found to be
exempt from the California Environmental Quality Act ("CEQA") as more fully described
below;
WHEREAS, on December 21, 2015 the Planning Commission of the City
of San Jacinto ("Commission") conducted a duly noticed public hearing on the
Application at which time all persons wishing to testify in connection with the Application
were heard and the Application was comprehensively reviewed; and
WHEREAS, all other legal prerequisites to the adoption of this Resolution
have occurred.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
SAN JACINTO RESOLVES AS FOLLOWS:
SECTION 1 . Based on the entire record before the Commission, all
written and oral evidence presented to the Commission, and the findings set forth in this
Resolution, the Commission grants Conditional Use Permit (CUP) No. 15-5 to establish
a satellite Kindergarten for San Jacinto Valley Academy on the Subject Site, and subject
to the Conditions of Approval.
SECTION 2. Based on the entire record before the Commission and all
written and oral evidence presented to the Commission, including the staff report, the
Commission finds as follows:
A. The kindergarten use, under CUP 15-5 is consistent with the
General Plan land use designation of Community Commercial (CN) for the Subject Site
and promotes the General Plan Goal for Public Education to ensure a sufficient level of
public education is available to the community.
B. The kindergarten, as an educational use is permitted within the
Commercial Neighborhood (CN) zone, subject to a Conditional Use Permit and it
complies with the provisions of the San Jacinto Development Code and the Municipal
Code, in that the kindergarten operation and hours are different than that of the Church
and it meets the parking requirements.
C. The design, location, and operating characteristics of the
kindergarten will be compatible with existing and future uses in the vicinity in that
education facilities K-12 are also permitted in the adjacent Residential Medium (RM)
zone and the project is required to install a decorative block wall on the northern
property line to separate the church/school use from the adjacent mobile home park.
D. The site is physically suitable to accommodate the kindergarten
use, in that the site is currently designed and developed to accommodate the church
and four existing classrooms, an existing parking lot with two points of access to Main
Street, can accommodate emergency vehicles, is served by utilities, and its hours of
operation do not conflict with the church hours.
E. The CUP is consistent with the General Plan and Development
Code of the City of San Jacinto, will not be detrimental to the public health, safety, or
welfare, and will not be materially injurious to properties or improvements in the vicinity
because the CUP provides for land uses compatible with the CN and RM zones and the
Conditions of Approval will require a block wall to separate uses and improved traffic
circulation.
SECTION 3. Based on the entire record before the Planning Commission
and all written and oral evidence presented, the Planning Commission finds the CUP
complies with CEQA for the following reasons:
This proposal is located in an existing facility and is a Class 1
exemption, pursuant to Section 15301 of the California
Environmental Quality Act
PASSED, APPROVED AND ADOPTED this 21st day of December 2015.
