A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SAN JACINTO, CALIFORNIA, AMENDING
CONDITIONAL USE PERMIT NO. 4-06 AMENDMENT NO. 2
TO MODIFY THE DESIGN OF A WIRELESS
TELECOMMUNICATIONS FACILITY LOCATED AT 1531
MOUNTAIN AVENUE: CUP NO. 4-06
WHEREAS, Sequoia Development Services filed an application on March 14,
2014 on behalf of Verizon Wireless, File No. CUP 4-06 Amendment No. 2, to amend the
conditional use permit to modify the antenna array of an existing 50 ft. mono-elm by
replacing 12 antennas (4 1/2 ft. in length), adding 6 remote radio units, 1 junction box, and 2
hybrid fiber cables. No changes are proposed to the simulated broadleaf mono-elm
("Application") on approximately 9.08 acres, (APN 547-130-008) ("Subject Site");
WHEREAS, the property affected by the Application is within the Commercial
Neighborhood (CN) zoning district; and
WHEREAS, the property affected by this Application is designated as
Community Commercial (CC) on the San Jacinto General Plan General Plan; and
WHEREAS, the Application was reviewed and found to be exempt from the
California Environmental Quality Act ("CEQA") under Categorical Exemption 15301 (Minor
alteration to existing facilities); and
WHEREAS, on May 8, 2014, the Planning Commission of the City of San
Jacinto ("Commission") conducted a duly noticed public hearing on the Application at which
time all persons wishing to testify in connection with the Application were heard and the
Application was comprehensively reviewed; and
WHEREAS, all other legal prerequisites to the adoption of this Resolution
have occurred.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF SAN
JACINTO RESOLVES AS FOLLOWS:
SECTION 1. Based on the entire record before the Commission, all written
and oral evidence presented to the Commission, and the findings set forth in this
Resolution, the Commission approves Conditional Use Permit No. 4-06 Amended No. 2 to
modify a wireless telecommunications facility at the Subject Site, subject to the conditions of
approval.
SECTION 2. Based on the entire record before the Commission and all written
and oral evidence presented to the Commission, including the staff report, the Commission
finds as follows:
A. The location of Conditional Use Permit No. 4-06 Amendment No. 2 has operated in
accord with the objectives of the City of San Jacinto Development Code and the
purposes of the existing zoning in which the site is located. The site is zoned
Commercial Neighborhood (CN). Therefore, the use is consistent with the goals and
objectives of the CN zoning district
B. The location of Conditional Use Permit No. 4-06 Amendment No. 2 and the
conditions under which it has and would be operated or maintained will not be
detrimental to the public health safety or welfare, or materially injurious to properties
or improvements in the vicinity. As stated above the project is consistent with the
zone classification for the site and the land use element of the General Plan. Further,
the project has been reviewed by City agencies and has been conditioned
accordingly. Follow up inspections by the City of San Jacinto will be done as needed
to ensure public health, safety and welfare.
C. Conditional Use Permit No. 4-06 Amendment No. 2 has and will comply with each of
the applicable provisions of the City of San Jacinto Development Code. The use is
consistent with the intent and purposes of the Development Code and applicable
provisions of the General Plan by providing communications services in the City and
in the region in the form of an attractive stealth mono-elm structure. The project has
no impact upon the circulation system in the area.
SECTION 3. Based on the entire record before the Planning Commission and
all written and oral evidence presented, including the staff report, the Planning Commission
finds the nature and extent of the dedications, reservations, impact fees, and other
exactions, as required, are reasonably related to public needs and roughly proportional to
the impacts created by use of the Subject Site as permitted by the CUP;
SECTION 4. Based on the entire record before the Planning Commission and
all written and oral evidence presented, the Planning Commission finds the CUP complies
with CEQA for the following reasons:
The project is exempt from the California Environmental Quality Act under
Categorical Exemption 15301 (Minor alteration to existing facilities). No
environmental review is required under the California Environmental Quality
Act (CEQA).
SECTION 5. Effective Date. This Resolution shall become effective on the
date on which it is approved by the Planning Commission.
PASSED, APPROVED AND ADOPTED, this 8th day of May, 2014.
