COUNTY OF RIVERSIDE ) ss
CITY OF SAN JACINTO )
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JACINTO, CALIFORNIA, ESTABLISHING AN
EMERGENCY MEDICAL SERVICES RESPONSE FEE
AND EMERGENCY MEDICAL SERVICES SUBSCRIPTION
PROGRAM FEES
WHEREAS, the City of San Jacinto ("City") contracts with the Riverside
County Fire Department to provide first responder and emergency medical services to
all emergency 9-1-1 calls; and
WHEREAS, the Riverside County Fire Department, as a contractor that
passes its costs along to the City, is authorized to charge a fee for any service it
provides pursuant to California Health and Safety Code section 13916; and
WHEREAS, the high volume of calls that the Riverside County Fire
Department responds to on behalf of the City represents a significant drain on the City's
finances and could jeopardize the ability of the City to continue providing first responder
and emergency medical services; and
WHEREAS, the City Council ("City Council") of the City of San Jacinto has
determined that recovery of certain costs incurred in responding to calls for emergency
medical services is essential for the continued services of a modern and professional
public safety and emergency response operation within the City; and
WHEREAS, on March 1, 2016, the City Council approved Ordinance
No. 16-02, establishing a fee for emergency medical services response, establishing an
Emergency Medical Services Subscription Program ("EMS Subscription Program"), and
establishing fees for such EMS Subscription Program; and
WHEREAS, the fees set forth herein have been calculated not to exceed
the reasonable cost of providing the emergency medical services response or
administering the Emergency Medical Services Subscription Program; and
WHEREAS, the City Council desires to set the amounts of the Emergency
Medical Services Response Fee and the EMS Subscription Program Fees; and
WHEREAS, all other legal prerequisites to the adoption of this Resolution
have occurred.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN
JACINTO RESOLVES AS FOLLOWS:
SECTION 1. Recitals. The Recitals set forth above are true and correct
and are hereby incorporated and adopted as findings by the City Council as though fully
set forth herein.
SECTION 2. Emergency Medical Services Response Fee and EMS
Subscription Program Fees. The City Council hereby establishes that the Emergency
Medical Services Response Fee and the EMS Subscription Program Fees for the City
of San Jacinto shall be as described in Exhibit "A," attached hereto and incorporated
herein by reference. The fees set forth in Exhibit "A" have been calculated not to
exceed the reasonable cost of providing the emergency medical services response or
administering the Emergency Medical Services Subscription Program.
SECTION 3. Community Facilities District 2003-1. The City Council
finds that the residential properties within Community Facilities District 2003-1 pay a
special tax, assessment, or other annual charge that is specifically imposed to cover the
costs of emergency medical services, and therefore the permanent residents within
Community Facilities District 2003-1 shall be exempt from the Emergency Medical
Response Fee while permanently residing within Community Facilities District 2003-1.
SECTION 4. Fee Adjustment. The Emergency Medical Services
Response Fee and the EMS Subscription Program Fees may be adjusted periodically
by Resolution of the City Council or through the City's master fee schedule update.
Unless otherwise adjusted by the City Council, the fees set forth in Exhibit "A" shall
automatically adjust each fiscal year in an amount proportional to the amount of any
increase in the Riverside County Fire Department's cost of providing service to the City.
The adjustment shall be rounded down to the nearest dollar.
SECTION 5. CEQA. The City Council hereby finds that this Resolution is
exempt from further environmental review pursuant to the California Environmental
Quality Act (Pub. Resources Code, §§ 21000 et seq.) ("CEQA") because, pursuant to
section 15378(b)(4) of the California Code of Regulations, this Resolution does not
constitute a "project" because it constitutes merely the establishment of government
fiscal activities that do not involve any commitment to any specific project that may
result in a potentially significant physical impact on the environment. In addition,
pursuant to section 15273 of the California Code of Regulations, CEQA does not apply
to this Resolution because this Resolution constitutes the modification and restructuring
of charges by the city that the City Council hereby finds are for the purpose of meeting
operating expenses, as more specifically established by the findings contained in the
Recitals to this Resolution. Therefore, City staff is hereby directed to file a Notice of
Exemption with the County Clerk within three (3) days following the adoption of this
Resolution.

SECTION 6. Severability. If any provision or clause of this Resolution or
its application to any particular set of facts or circumstances is held invalid, such
invalidity shall not affect other provisions of this Resolution that can be given effect
without the invalid provision or application, and to this end, the provisions of this
Resolution are declared to be severable.
SECTION 7. Effective Date. This Resolution shall become effective on
the effective date of Ordinance No, 16-02.
