A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JACINTO, CALIFORNIA, RECITING THE FACT OF THE SPECIAL ALL
MAIL BALLOT MUNICIPAL ELECTION CONDUCTED ON MAY 512015
AND DECLARING THE RESULTS OF SAID ELECTION
WHEREAS, the City of San Jacinto held a Special all mail ballot municipal
election on May 5, 2015 with regard to Ballot Measure "A" (Utility Users Tax Initiative),
as designated by the Resolution No. 3553 and as otherwise required by law; and
WHEREAS, notice of the election was given in time, form and manner as
provided by law, ballots were properly mailed to registered voters within the City, and
that in all respects the votes were cast by mail, received and canvassed and the returns
made and declared in time, form and manner as required by the provisions of the
Elections Code of the State of California for the holding of all mail ballot elections in
general law cities; and
WHEREAS, on May 12, 2015, the City of San Jacinto City Clerk canvassed the
returns of the special all mail ballot election and certified the results of the canvass, as
required by state law; and
WHEREAS, the results of said certified canvass are attached hereto as Exhibit A
and incorporated by reference herein.
NOW, THEREFORE, BE IT RESOLVED, determined and ordered by the City
Council of the City of San Jacinto, that at this time the City Council desires to declare
the results of the election, pursuant to California Elections Code 10263 and 10264:
SECTION 1. Recitals. The above recitals are all true and correct.
SECTION 2. Declaration of Election Results. This City Council does hereby
declare, pursuant to Elections Code sections 10263 and 10264, the
following results of the Special all mail ballot Municipal election for
Ballot Measure "A" of May 5, 2015:
Whole number of all mail ballot votes cast in City of San Jacinto:
3571
Measure "A" — City of San Jacinto Utility Users Tax Initiative
YES 1406
NO 2155
Total 3571
SECTION 3. The City Council does declare and determine that a majority of the
voters voting on Ballot Measure "A" relating to the Utility Users Tax Initiative did not vote
in favor of it, and that the Measure was not carried, and shall not be deemed adopted
and ratified.
SECTION 4. The City Clerk shall enter on the records of the City Council of the
City, as statement of the result of the all mail ballot election, showing (i) the whole
number of all mail ballots cast in the City; (ii) the measure voted upon; and (iii) the total
number of all mail ballot votes for and against the measure.
SECTION 5. The City Clerk shall certify to the approval and adoption of this
Resolution and enter it into the book of original Resolutions.
PASSED, APPROVED, and ADOPTED this 215t day of May, 2015, by the
following vote:
