("CRL") and the Redevelopment Plan; and WHEREAS, the Agency is required to set aside at least 20% of its tax increment revenue generated from the project area for the purpose of increasing, improving, and preserving the community's supply of low and moderate income housing (CRL 33334.2); and WHEREAS, Section 33334.2(e) of the CRL authorizes the Agency to exercise its powers for the construction, rehabilitation, or preservation of affordable housing for extremely low, very low, low, and moderate-income persons or families ("Low-Mod Housing"); and WHEREAS, pursuant to Section 33334.2(e)(7) of the CRL, in preserving Low- Mod Housing, the Agency may rehabilitate buildings or structures; and WHEREAS, as a result of severely high and damaging winds commencing on or about 12:00 a.m. (midnight) on the 21st day of October, 2007 ("Emergency Conditions"), many Low-Mod Housing units, including mobile home units, located in the Project Area have been severely damaged; and WHEREAS, the Agency desires to make available a total of One Hundred Eighty Thousand Dollars ($180,000) of Low-Mod Housing Funds for the repair and rehabilitation of Low-Mod Housing units damaged by the Emergency Conditions; and RVPUB\HSHANR740479.2 Page 1 of 4 WHEREAS, the Agency desires to make this funding available, in the form of a grant, to qualifying low to moderate income households, as defined in the CRL and in Title 25 California Code of Regulations Section 6932, in an amount not to exceed Five Thousand Dollars ($5,000) per household; and WHEREAS, without an allocation of such funding, many qualifying Low-Mod Housing owners may not be able to make required repairs, and the units may become unfit for human habitation; and WHEREAS, the Agency has Low-Mod Housing Funds available, in the requested amount, from the proceeds of the Agency's tax-exempt bond issue of 2005, which funding can be allocated for this purpose for the current budget year; and WHEREAS, allocating funds for the rehabilitation of Low-Mod Housing units severely damaged by the Emergency Conditions will be of benefit to the Project Area, as the rehabilitation work to be carried out pursuant to this authorization and funding allocation will reduce physical blight in the Project Area; and WHEREAS, the grant program will provide resources to assist with the repairs necessary to ensure these affordable units are preserved as part of the community's affordable housing stock. NOW, THEREFORE, BE IT RESOLVED, by the Board of the Redevelopment Agency of the City of San Jacinto: Section 1. Incorporation of Recitals. The recitals set forth above are true and correct and are incorporated by this reference as though fully set forth in this Resolution. Section 2. Funding Allocation. The Agency Board hereby approves the allocation of One Hundred Eighty Thousand Dollars ($180,000) of Low-Mod Housing Funds for the purpose set forth in this Resolution, and hereby directs the Agency's Finance Director to make the appropriate transfer of funds into an account for the purposes set forth herein. Section 3. Qualified Households. For purposes of this Resolution, qualified low to moderate income households shall be home or mobile home trailer owners, residing within the San Jacinto Redevelopment Project Area, that meet the eligibility definitions for persons and families of low or moderate income, lower income, very low income and extremely low income, as set forth in the CRL and the California Code of Regulations, whose homes or mobile home units have been significantly damaged by the Emergency Conditions ("Qualified Household"). Page 2 of 4 Section 4. Significant Damage. For purposes of this Resolution, "significant damage" shall mean damage that could result in the housing unit being removed from the community's affordable housing stock, including damage that impairs the structural viability of the affected residence, or that threatens to make the residence uninhabitable. Significant damage, as used herein, does not include damage that is purely aesthetic. Section 5. Allocation Per Qualifying Household. The total amount of funding to be provided per Qualified Household shall not exceed Five Thousand Dollars ($5,000). The funding shall be in the form of a grant, and shall be used solely for the purpose of emergency repairs and rehabilitation necessitated by the Emergency Conditions ("Emergency Repairs"). The Agency finds that this level of assistance does not qualify as substantial rehabilitation of the unit. Section 6. Disbursement of Funds. The Agency may disburse the allocated funds to a Qualified Household for reimbursement of approved Emergency Repairs upon presentation to the Agency of receipts for such repairs, and upon presentation of any other evidence of Emergency Repairs as may be required by the Agency. Alternatively, in its sole discretion, the Agency may arrange to pay allocated funds for approved Emergency Repairs directly to a contractor hired by a Qualified Household. Section 7. Adoption of Additional Guidelines. The Executive Director of the Agency is hereby authorized to adopt additional guidelines, as may be necessary or convenient, for implementation of this Resolution and disbursement of the funding as authorized herein. Section 8. Further Acts. The Executive Director of the Agency is authorized (with the concurrence of the City Attorney) to execute and deliver on behalf of the Agency any documents and instruments as may be necessary or convenient in the furtherance of the actions authorized by this Resolution. Section 9. CEQA Compliance. The Agency has determined that pursuant to Section 15378(b)(4) of the California Environmental Quality Act ("CEQA") Guidelines the funding allocation contemplated in this Resolution is not a "Project" subject to CEQA review and is therefore exempt from CEQA requirements because it is a government funding mechanism or other governmental fiscal activity which does not involve any commitment to any specific project which may result in a potentially significant impact on the environment. Section 10. Notice of Exemption. The Agency Board hereby authorizes and directs Agency staff to file a Notice of Exemption with the County Clerk of Riverside County within five (5) working days following adoption of this Resolution.
