Home My WebLink AboutResolution - 1678 San Jacinto 60,035-3-3 RESOLUTION NO. 1678 A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS PURSUANT TO SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS FOR THE ACQUISITION OF IMPROVEMENTS WITHOUT PROCEEDINGS UNDER DIVISION 4 OF THE STREETS AND HIGHWAYS CODE (ASSESSMENT DISTRICT NO. 87-1) WHEREAS, all of the owners of more than 60% in area of the property subject to assessment therefor have signed and filed with the Clerk of the this City a written petition for undertaking proceedings pursuant to special assessment and assessment bond acts, and to assess the costs thereof upon the properties benefited by said improvements, and waiving proceedings under Division 4 of the Streets and Highways Code, all as provided in Exhibit "A1l attached hereto and incorporated 'herein by reference; and WHEREAS, the costs and expenses of said contemplated acquisitions are to be chargeable upon an assessment dis- trict, the exterior boundaries of which are the coterminous exterior boundaries of the composite and consolidated area shown on the map thereof on file in the office of the City Clerk, to which reference is hereby made for further particu- lars; and WHEREAS, the public interest and convenience will be served by the taking of said proceedings. NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF SAN JACINTO AS FOLLOWS: Section 1. That all of the owners of more than 60% in area of the property subject to assessment for said -1- D0074:489.7 O1-27-87 (JAS:ld) San Jacinto 60,035-3-3 proposed acquisitions have filed with the Clerk of this City a written petition for the acquisition of improvements pursuant to appropriate special assessment and assessment bond acts, without further compliance with the provisions or limitations of Division 4 of the Streets and Highways Code. Section 2. That said proceedings for acquisition of said improvements shall be had pursuant to the Municipal Improvement Act of 1913 and the bonds upon the unpaid assess- ments thereof shall be issued pursuant to the Improvement Bond Act of 1915. Section 3. That the provisions and limitations of Division 4 of the Streets and Highways Code be, and they are hereby, dispensed with. Section 4. This Resolution shall take effect immediately upon its passage.
