RESOLUTION NO. 1588

A RESOLUTIOH OF THE CITY COUNCIL OF THE
2 CITY OF SAN JACINTO OVERRULING OBJECTIONS
AND DETERMINING 10 PROCEED WITH ABATEMENT

The City Council adapted Resolution No. 1583 on April 2, 1985 which
4 by its terms the Council elected to proceed under Government Cade Sections 39501-
39588 and did declare as a public nuisance all weeds growing upon streets, side-
5 walks and private property in the city and all rubbish, refuse and dirt upon park
ways, sidewalks and ,private property in the city; and

A public hearing was held an Play 7, 1?85 , and objections to the pro-
7 posed removal of weeds, rubbish,'reluse and dirt were made or presented either if
8 writing or orally;` None
NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED as follows:

10 1 . The foregoing is true.
11 2. The Council fixed May 7, 1985 at the hour of 7:30 p.m. o'clock
in the Council Chambers, as the time and,place for hearing all objections to the
12 proposed removal of weeds,rubbish, refuse and dirt, and the director of public
works was designated as the person to perform the duties imposed by Government
13 Code sections 39560-39588 upon the superintendent, and he did prepare notires to
destroy and remove rubbish, refuse and dirt; the city did mail written notice of
14 the proposed abatement to all persons owning property described in Resolution No
1583 in the time, form and manner prescribed by law.
15 3. The City Council did hold a public hearing an play 7, 1985 and ob
16 jections either written or oral to",the proposed removal of weeds, rubbish, refus
and dirt were presented, and the hearing was closed on Play 7, 1985.
17 4. The noxious and/or dangerous weeds growing in or upon or adjacent to rea
1® property described in Resolution No. 1583 are seasonal and recurrent nuisances.

and the superintendent is ordered to cause the abatement of the weeds from time,
21 to-time hereafter, as the weeds recur per section 39562.1 of the Government Code
Before the superintendent arrives, any property owner may remove the weeds, rub
22 bish, refuse and dirt at his own expense.
23 6. The superintendent or the contractor awarded the work, as the case may
shall keep an account of the cast of abatement in front of or on each separate
24 parcel of land where the work is done and modification and confirmation, an
itemized written report showing this cost, all as inure particularly described b
25 Government Code section 39574.
