OF SAN JACINTO, CALIFORNIA, DETERMINING

14EREA1, the Citv of San Jacinto (hereinafter referred to as 'Agency)
is a contracting Agency of the Public Employees' Retirement System; and

gl, 'HEREAS, the Public Emplovees' Retirement System law requires that a con-
(I' tractinq Agencv determine whether an employee of such Agencv in employment in

the Public Employees' Retirement System law and whether such disability in
31 court is industrial within the meaning of such law; and

l NO'�d, THEREFORE, BE IT RESOLVED: f

That the City of San Jacinto finds and determines, and it does here-
12 by find and determine that Edward F. Nelson is incapacitated within the mean-
ing of the Public Employees' Retirement System law for performance of his
13 duties in the position of police officer.
14 2. BE IT FURTHER RESOLVED:
15 That the City of San Jacinto finds and determines, and it does here-
by find and determine that such disability arises out of and in the course of
16 i emplovment, and neither the said Edward F. Nelson nor the Agencv of the City
of San Jacinto has applied to the l!orkers' Compensation Appeals Board for a
17 determination pursuant to Section 21026 whether such disability is industrial
and/or;

3. BE IT FURTHER RESOLVED that the member was separated from his employ-
