WILLUMSON ACT COMMACTIS
WHERFAS, the City Council of the City of San Jacinto (the "City Council") has
by Ordinance No. 754 on June 28, 1983, the Redevelopment Plan for the San Jacinto
Redevelopment Project (;he "Redevelopment Plan" and the 'Project"); and
WMREAS, the City Council did duly pass and adopt an ordinance whereby the San
Jacinto Redevelopment Plan was amended and Gamin territory was added to the Project covered
by the Redevelopment Plan in December, 1993 (the "Amendmean"); and
a portion of the territory added to the Project by the Amendment is subject
to contracts authorized by the 'Wiiliarnson Act% California Government Code Sections 51200,
er. seq, (the "Williamson Act Contracts" or "Contracts"), regarding the use of the properly
subject to the Contrails (the 'Williamson Act Lands"`) for agricultural purposes; and
WHEREAS, it is an established policy of the City and the Agency to encourage the
retention of agricultural uses whenever feasible: and
it is the intent of the San Jacinto Redevelopment Agency (the 'Agency")
that the rights of the State of California (the "State") to certain revenues in cotuiecnion with the
acquisition of property subject Williamson Act Contracts shall riot be affected by the inclusion of
Williamson Act Lattds within the Project.
NOW, THEREFORE9 THE SAN JACINTO REDEVELOPNWM AGENCY DOES
HEREBY RESOLVE As LL40WS:
Section - The Agency supports the policy of discouraging the premature and
unnecessary conversion of agricultural land to urban uses,
51=12 It is the pollcy of the Agency that money otherwise payable to the State
pursuant to the Williamson Act shall not be affected by the circumstance that the Agency may
condemn land subject to Williamson Act Contracts in the Project Area of the Project and
furthermore, it is the policy of the Agency that the condemnation by the Agency of Willianisuia
Act Lands in dse Project Area of the Project the State foregoing revenue that the Stare would
have received in connection with the cancellation of Williamson Act Contracts but for the
condemnation of such land.
Seaton� It is the policy of the Agency to refrain from the use of the power of
erniitent domain as m Williamson Act Lardx except in connection with the provision of
improvements beneficial to agricultural uses,
PASSED, APPROVED AND ADOPM this L4— day of Feb._, 1994 at a special
meeting of the San Jacinto Redevelopment Agency by the following vote:
