A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN JACINTO, CALIFORNIA, ADOPTING A HOUSEHOLD
HAZARDOUS WASTE ELEMENT PURSUANT TO THE
CALIFORNIA INTEGRATED WASTE MANAGEMENT ACT
OF 1989
WHEREAS,the California Integrated Waste Management Act of 1989 (the "Act")
requires local governments to prepare and adopt a Household Hazardous Waste
Element which will divert household hazardous waste from landfill or transformation
facilities; and
WHEREAS, the City of San Jacinto has prepared and completed a negative
declaration for the project; and
WHEREAS, notice of the public hearing on the Household Hazardous Waste
Element was given in a newspaper of general circulation for the period of time
prescribed by law;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San
Jacinto does hereby resolve, order and determine as follows:
SECTION 1. The City Council certifies that it has reviewed and considered the
negative declaration which was prepared for this project, and adopts the finding that
there is no substantial evidence that the proposed project will have a significant effect
on the environment.
SECTION 2. The City Council hereby adopts the negative declaration for the
project based on the finding that there is no substantial evidence that the project will
have a significant effect on the environment, and on the finding that the proposed project
does not require the preparation of an environmental impact report.
SECTION 3. The City Council hereby approves and adopts the Household
Hazardous Waste Element, a copy of which is attached hereto, as its integrated waste
management plan as required under the Integrated Waste Management Act of 1989, and
authorizes and directs City staff to implement the programs contained in the Element.
SECTION 4. The City Clerk is directed to file and post a Notice of Determination
in accordance with the provisions of the California Environmental Quality Act, and to file
the Source Reduction and Recycling Element with the County of Riverside immediately
upon adoption of this Resolution.
BE IT FURTHER RESOLVED that this Resolution shall become effective upon the
date of its adoption, in accordance with the intent as hereinabove set forth.
