INC. THE CITY COUNCIL OF THE CITY OF SAN JACINTO, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: 1. FACTS: Pursuant to Government Code § 3505, representatives of the City and of the Public Employees Association of Riverside County, Inc. ("Association") have met and conferred in good faith in an effort to reach an agreement upon a successor to the 1992-94 Memorandum of Understanding between the parties. 2 . The parties have failed in their effort to reach such an agreement and are at an impasse in that a point has been arrived at in the meet and confer process where the differences between the parties on matters to be included in a Memorandum of Understanding remain so substantial that further meeting and conferring would be futile. NOW, THEREFORE, BE IT RESOLVED THAT pursuant to the authority vested in it by the Government Code and other applicable rules, regulations, statutes and practices, the City Council does take the following action that in its sole discretion, it deems appropriate as in the public interest in order to resolve the impasse now existing between the City and the Association: 1. VACATION ACCUMULATION CAP: Elimination of the ten (10) day maximum on vacation accrual/carry-over and substitution of a vacation accrual/carry-over limitation equivalent to what any affected employee would earn during a two (2) year period of time at the employee' s then existing rate of accrual. If an employee reaches his/her maximum accrual of vacation, then no additional vacation hours shall be earned until the employee has utilized vacation so as to cause less than (2) years of vacation accrual to remain in the employee' s account. (modifying Section 5. 2 (f) of the 1992-94 MOU) ; 2 . AUTOMOBILE USE: Increasing employee reimbursement for use of his/her personal automobile on City business, from 26 cents per mile to 29 cents per mile.
