A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN JACINTO
ESTABLISHING NORTH STATE STREET
UNDERGROUND UTILITY DISTRICT NO. 1
BE IT RESOLVED By the Council of the City of San Jacinto as follows:
WHEREAS, by Resolution No.95-3, a public hearing was called for February 21,
1995 and March 7, 1995, at the hour of 7:30 p.m. in the Council Chambers in the City Hall,
of San Jacinto, California, to ascertain whether the public necessity, health, safety, welfare
requires the removal of poles, overhead structures and the underground installation of
wires and facilities for supplying electric, communication, or similar or associated service
on State Street, as shown on Exhibit "A"; and
WHEREAS, notice of such hearing has been given to all affected property owners
as shown on the last equalized assessment roll and utilities concerned in the manner and
for the time required by law; and
WHEREAS, such hearing has been duly and regularly held, and all persons
interested have been given an opportunity to be heard.
NOW, THEREFORE, Be it Resolved that the Council of the City of San Jacinto
hereby finds and determines that the public necessity, health, safety and welfare require
the removal of poles, overhead wires and associated structures, and the underground
installation of wires and facilities for supplying electric communication, or similar or
associated service on State Street as shown on Exhibit "A" and such described area is
hereby established as the North State Street Underground Utility District No. 1:
RESOLVED, FURTHER, that the Council finds: (use one or more of the following:)
(a) That such undergrounding will avoid or eliminate an unusually heavy
concentration of overhead electric facilities;
(b) The street or road right-of-way is extensively used by the general public and
carries a heavy volume of pedestrian or vehicular traffic;
RESOLVED, FURTHER, that all poles, overhead wires and associated overhead
structures shall be removed and underground installations made in said underground
utility district within the following times:
(a) Underground installation by utility companies and property owners and
reconnections not later than June 30, 1996;
(b) Removal of poles, overhead wires and other associated structures not later than
June 30, 1996;
RESOLVED, FURTHER, that the City Clerk, within ten (10) days after the adoption of
this resolution, shall mail a copy hereof and a copy of Chapter 12.28 of the Municipal Code
to affected property owners as such are shown on the last equalized assessment roll and
to the affected utilities.
