A RESOLUTION OF THE CITY COUNCIL FOR THE CITY
OF SAN JACINTO ESTABLISHING RATES FOR THE
COLLECTION OF RECYCLABLE MATERIALS
Recitals:
a) . In 1989 , the California legislature enacted the
California Integrated Waste Management Act of 1989 , (hereinafter
"Act) . The Act requires, in part, that municipalities divert no
less than 25% of materials from the landfills by the 1995, and no
less than 50% by the year 2000.
b) . In furtherance with the Act, the City of San Jacinto,
on March 21, 1995, approved and executed the City-to-City
Agreement with the City of Hemet, whereby the Cities have agreed
to cooperate in source reduction and recycling efforts. Pursuant
to the City-to-City Agreement, a program of services has been
developed for implementation by June 5 1995
c) . A budget has been prepared for the services to be
provided to our citizens of San Jacinto, including
administrative, mandated state reporting and operational costs.
The charges to customers are based upon the actual estimated
costs for the operation and administration of the program.
d) . Due notice has been made of the public hearing on the
setting of the fees for service, pursuant to Government Code
Section 60018 . Pursuant to notice, the hearing was held on
April 4 , 1995, 7 : 30 P.M. , at a regular meeting of the City
Council .
NOW THEREFORE, the City Council of the City of San Jacinto
does hereby resolve as follows:
Section 1. The facts stated in the recitals set forth above
are true and correct.
Section 2 . All proceedings in the setting of rates have been
duly and regularly taken.
Section 3 . The rates to be charged to residents within the
City of San Jacinto for recycling services under
the City-to-City Agreement are hereby established
as shown on the attached Exhibit "A" . Basic
service rate charges (not including optional
service programs) , for programs necessary to reach
state mandated diversions, shall be a mandatory

charge upon all customers required to maintain
refuse service within the City of San Jacinto.
Section 4 . The rates contained in "Exhibit All will
become effective May 1, 1995 .
Approved and adopted this 4th day of April, 1995, by the
following vote :
AYES : Councilmembers Leahy, Oaks and Williams
NOES : Mayor Pro Tem Solorio
ABSENT: Council Seat Xacant
ABSTAIN: None y
