2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN_JACINTO SETTING FORTH THE SEWER RENTAL FEES
3 PURSUANT TO THE AUTHORITY OF SECTION 16-91 'OF
THE CODE OF THE CITY OF SAN' JACINTO

5 The City Council of the City of San Jacinto, ' a California
municipality, does hereby resolve as follows':

SECTION 1 ; This resolution sets forth the rates for sewer
7 rental 'fees to include 'fees , for sewage disposal and for sewage
collection.

SECTION 2 : For the purposes of this resolution the following
`9 definitions shall apply:
10 A. Unite A unit is defined as a single family dwelling
or apartment which includes kitchen and bathing facilities; an
11 office, or a commercial place of business. All service charges are
12 � levied per each unit unless otherwise stated in this resolution.
B. Parcel; A parcel is defined as a piece of ground
-13 which cannot he divided into separate parcels under existing
ordinance of the City of San Jacinto.

C. Improved Parcel- An improved parcel is defined as a;
15 parcel upon which has been placed one or more units.
16 D. Mobilehome park: A 'parcel under common ownership
having a valid mobilehome park permit renting spaces for the keeping
17 of mobilehome for ''terms of less than one year.
18 E. Single Family Dwelling . Shall include a mobilehome
used for residential purposes located on any parcel not;a mobile
19 home park.
20 F. Bimonthly- The time; period for charges on a two-
month billing cycle per Section 21-33 of City Code.

SECTION 3e The sewer rental charges as authorized by Ordin-
22 ance No. 361 of said city ,are hereby established as follows :
23 A. Single family residences : $1.00 bimonthly for City
of San Jacinto collector charges and $2 .00 bimonthly per agreement
24 for disposal by Eastern Metropolitan Water District for a total of
$3.00 bimonthly.

B. All other premises except mobilehome parks, hotels,
26 motels, :or board houses, $1.00 bimonthly for City of San Jacinto
collector charges and $2 .00 bimonthly per agreement for disposal
27 by Eastern Metropolitan Water District for a total of $3 .00 b'i-
monthly ;or Ten Percent (10) of the monthly charges for water
28 services to such premises, whichever shall be the greater.
29 C. Mobilehome parks shall be charged as follows .
Mobilehome parks shall be charged $1.00 `bimonthly for
30 City of San Jacinto collection charge per unit and $2 .00 bimonthly
per agreement for disposal by Eastern Metropolitan WaterDistrict
31 per unit for a total of $3 .00 bimonthly per unit . Each mobilehome
space within a mobilehome park shall be equal to three-fifths of a'
32 unit, and each mobilehome park shall be charged a bimonthly fee

l according to the number; of units existent in; said ,park, unless on
or before the tenth day of each bimonth period the owner or opera-
2 for of such mobilehome ,'park shall 'declare under penalty of perjury,
on the form provided therefor to the Clerk of the Water Department
3 of the ` City 'of San Jacinto, the number of spaces actually occupied
in such' mob'ilehome park during the preceding bimonth period. in tIT-
4 event of such declaration the fee for such mobilehome park shall be
based upon the number of spaces occupied during such bimonth period.

For the;purpose of this "section, occupancy shall include
6 any time during which such space shall have been rented whether or
not the tenant shall have been actually present, or whether or not
7 the rental thereon shall have been paid.
8 The owner or operator shall maintain records pertaining
to occupancy and said records shall be available for inspection by
- 9 the Clerk of the Water `Department` or his duly authorized repre-
sentative at all reasonable' times.

D. Each unit or space available for separate occupancy
11 within a hotel, motel, or boarding house shall be equal to two-
fifths of a unit, and each hotel, :motel, or boarding house shall
12 be charged a bimonthly fee according to the number of units exis-
tent in said hotel, motel or boarding house, unless on or before
13 the tenth day of each bimonthly period the owner or operator of
such hotel, " motel <or boarding house shall declare under penalty of
14 perjury; on the form provided therefor to the Clerk of the Water
Department of the `City -of San Jacinto the number of units or
15 spaces actually occupied in such hotel, motel, or boarding house
shall be based upon the number of 'spaces occupied during such
16 bimonth period .
17 SECTION-4: The fee for premises ,lying outside the City' limits
of the City of San Jacinto and being served by the sewer system of
181 the City of San Jacintoshall be three (3) times the charge herein-
before set forth and established for premises lying inside the
19 City limits of the city limits of the City of San Jacinto.
20 SECTION 5 : This resolution shall be deemed effective from the
first collection cycle commencing after December 26, 1972 and in
21 ratification of the action of the 'city council at its meeting of
December 26, '1972 increasing the monthly unit charge for disposal
22 of sewage by ,Eastern Metropolitan Water District from 50 cents to
$1.00 .
