2 A RESOLUTION OF THE CITY OF SAN;JACINTO OVERRULING
OBJECTIONS AND DETERMINING TO PROCEED WITH ABATEMENT

The City Council adopted Resolution No. 1137 on March 22, 1077, which by its
4 terms the Council elected to proceed under Government Code- Sections 39501-39588
and did declare as a public nuisance all weeds: growing upon streets, sidewalks
5 and private property in the city and all rubbish, refuse and dirt upon parkways ,
sidewalks and private property in the city; and

A public hearing was held on April 19, 1977, and objections to the proposed re-
7 moval of weeds, rubbish, refuse;and dirt were;made or presented either in writing
or orally;
NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED as follows :

1 . The foregoing is true.
10 2. The Council 'fixed April 19, 1977 at the hour of -7:30 p.m. in the Coun-
cil Chambers, as the time and place for hearing all objections to the proposed
11 1 removal of weeds, rubbish, refuse and dirt, and the director of public works was )
designated as the person to perform the duties imposed by Government Code Sec- I
12 +; tions 39560-39588 upon the superintendent, and; he did prepare notices to destroy
and remove rubbish, refuse and dirt; the city did mail written notice;of the pro-
" 13 posed abatement to all persons owning property described in Resolution No. 1137
in the time, form and manner prescribed by law.
14 3. The City Council did hold a public hearing on April 19, 1977, and ob-
_jections either written or oral to the proposed removal of weeds, rubbish, refuse
15 and dirt were presented, and the hearing was closed on April 19, 1977. `
4. - The:noxious and/or dangerous weeds growing in or upon or adjacent to
16 real property described in Resolution No'. 1137"are seasonal and recurrent nui-
sances.
17 5. The superintendent is ordered to abate the nuisance declared by Resolu-
tion No. 1137 by having the weeds, rubbish, refuse and dirt removed and for this
18 purpose the superintendent may enter upon private property to abate the nuisance,
and the superintendent is ordered to cause the abatement of the weeds from time-
19 to-time hereafter as the weeds recur per Section 39562. 1 of the Government Code.
Before the superintendent arrives , any property owner may remove the weeds, rub- �
20 I bi sh, refuse and dirt at his own expense_ {
6. The superintendent or the contractor awarded the work, as the case may
-21 ; be shall keep an account of the cost of abatement in front of or on each sepa-
rate parcel of land 'where the work is done and modification and confirmation, anI
22 itemized written report showing this cost, all as more particularly described by
Government Code Section 30574

ADOPTED by the City Council of the City of San Jacinto on Argil 19, 1977 by the

AYES: Councilmen'Ver Plank, Hazeltine, Stevens, Brooks and Wilson;
25 NOES: None
