2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JACINTO, A CALIFORNIA MUNICIPALITY, SUPPORTING SB 839

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN JACINTO AS FOLLOWS:

WHEREAS , the "Soby Decision" has placed an onerous burden on the Cities
5
and Counties of the State of California to the extent that large sums of money
6
are required for potential post retirement workers' compensation heart attack
7
cases for policemen and firemen, and

WHEREAS, the City of San Jacinto believes that the original intent of the
9
presump' ive clause of Labor Code Section 3212 did not call for the granting of
10
workers ' compensation benefits for heart attack cases occurring after retirement
11
or termination; and
12
WHEREAS, SB 839 (Way) would reverse the effect of the "Soby Decision" ;
13
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San
14
Jacinto supports SB 839 and
15
BE IT FURTHER RESOLVED that copies of this resolution be sent to Senator
16
lHoward Way, to the Senator and Assemblyman representing our districts and to the

League of California Cities.

PASSED AND ADOPTED by the City Council of the City of San Jacinto at a
19
20 regular adjourned meeting held May 20. 1975.
