2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JACINTO SETTING FORTH THE SEWER RENTAL
3 FEES PURSUANT TO THE AUTHORITY OF SECTION
16-91 OF THE CODE OF THE CITY OF SAN JACINTO.

The City Council of the City of San Jacinto, a California
5 municipality, does hereby resolve as follows :
6 SECTION 1 : This resolution sets forth the rates for sewer
rental fees to include fees for sewage disposal and for sewage
7 collection.
8 SECTION 2 : For the purposes of this resolution the following
definitions shall apply:

A. Unit: A unit is defined as a single family dwelling
10 or apartment w i�i'cF—includes kitchen and bathing facilities; an
office, or a commercial place of business. All service charges are
11 levied per each unit unless otherwise stated in this resolution.
12 B. Parcel: A parcel is defined as a piece of ground
which cannot be--"divided into separate parcels under existing
13 ordinance of the City of San Jacinto.
14 C. Improved Parcel : An improved parcel is defined as a
parcel upon which has been placed one or more units.

D. Mobilehome Park: A parcel under common ownership
16 having a valid mobilehome---p—ar-k permit renting spaces for the keeping
of mobilehome for terms of less than one year.

E. Single Family Dwelling: Shall include a mobilehome
18 used for residential purposes located on any parcel not a mobile-
home park.

F. Bimonthly: The time period for charges on a two-
20 month billing cycle per Section 21-33 of City Code.
21 SECTION 3 : The sewer rental charges as authorized by ordin-
ance No. 361 of said city are hereby established as follows :

A. Single family residences: $1. 00 bimonthly for City
23 of San Jacinto collector charges and $3.50 bimonthly per agreement
for disposal by Eastern Metropolitan Water District for a total of
24 $4.50 bimonthly.
25 B. All other premises except mobilehome parks , hotels,
motels, or board houses , $1. 00 bimonthly for City of San Jacinto
26 collector charges and $3.50 bimonthly per agreement for disposal
by Eastern Metropolitan Water District for a total of $'4.50 bi-
27 monthly or Ten Percent (10%) of the monthly charges for water
services to such premises, whichever shall be the greater.

C. Mobilehome parks shall be charged as follows :
29 Mobilehome parks shall be charged $1. 00 bimonthly for
City of San Jacinto collection charge per unit and $3. 50 bimonthly
30 per agreement for disposal by Eastern Metropolitan Water District
per unit for a total of $4.50 bimonthly per unit. Each mobilehome
31 space within a mobilehome park shall be equal to three-fifths of a
unit, and each mobilehome park shall be charged a bimonthly fee
32 according to the number of units existent in said park, unless on

1 on or before the tenth day of each bimonth period the owner or opera-
tor of such mobilehome park shall declare under penalty of perjury
2 on the form provided therefor to the Clerk of the Water Department
of the City of San Jacinto, the number of spaces actually occupied
3 in such mobilehome park during the preceding bimonth period. In th
event of such declaration the fee for such mobilehome park shall be
4 based upon the number of spaces occupied during such bimonth period
5 For the purpose of this section, occupancy shall include
any time during which such space shall have been rented whether or
6 not the tenant shall have been actually present, or whether or not
the rental thereon shall have been paid.

The owner or operator shall maintain records pertaining
8 to occupancy and said records shall be available for inspection by
the Clerk of the Water Department or his duly authorized repre-
9 sentative at all reasonable times.
10 D. Each unit or space available for separate occupancy
within a hotel, motel, or boarding house shall be equal to two-
11 fifths of a unit, and each hotel , motel, or boarding house shall
be charged a bimonthly fee according to the number of units exis-
12 tent in said hotel, motel or boarding house, unless on or before
the tenth day of each bimonthly period the owner or operator of
13 such hotel, motel or boarding house shall declare under penalty of
perjury on the form provided therefor to the Clerk of the Water
14 Department of the City of San Jacinto the number of units or
spaces actually occupied in such hotel, motel , or boarding house
15 shall be based upon the number of spaces occupied during such
bimonth period.

SECTION 4 : The fee for those parcels located in Tract No.
17 4421 of this City (Penn-West Subdivision) subject to Eastern Muni-
cipal Water District Improvement District No. U-14 shall include
18 $2 .00 a bimonthly period additional charge for the assessment for
that Improvement District for a total charge of $5.50 per bimonthl
19 period.
20 SECTION 5 : The fee for premises lying outside the City limit
of the City of San Jacinto and being served by the sewer system of
21 the City of San Jacinto shall be three (3) times the charge herein
before set forth and established for premises lying inside the
22 City limits of the City limits of the City of San Jacinto.
23 SECTION 6 : This resolution shall be deemed effective from th
first collection cycle commencing after August 21st , 1975 .

26 AYES : Councilmen Brooks, Stevens and Wilson.
27 NOES: None.
28 ABSTAIN: Councilwoman Hazeltine and Mayor Wallace.
