2 A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN JACINTO OVERRULING OBJECTIONS
3 AND DETERMINING TO PROCEED WITH ABATEMENT
4 The City Council adopted Resolution No. 1275 on October 23, 1979 " , which
by its terms the Council elected to proceed under Government Code Sections 39501-
5 39588 and did declare as a public nuisance all weeds growing upon streets, side-
walks and private property in the city and all rubbish, refuse and dirt upon park
6 ways, sidewalks and private property in the city; and
7 A public hearing was held on November 7, 1979 , and objections to the pro-
posed removal of weeds, rubbish, refuse and dirt were made or presented either in
- g writing or orally;
9 NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED as follows:
10 1 . The foregoing is true.
11 2. The Council fixed November 7, 1979 at the hour of 7:30 p.m. o'clock
in the Council Chambers, as the time and place for hearing all objections to the
12 proposed removal of weeds, rubbish, refuse and dirt, and the director of public
works was designated as the person to perform the duties imposed by Government
13 Code sections 39560-39588 upon the superintendent, and he did prepare notices to
destroy and remove rubbish, refuse and dirt; the city did mail written notice of
14 the proposed abatement to all persons owning property described in Resolution No.
in the time, form and manner prescribed by law.

3. The City Council did hold a public hearing on November 7, 1979 , and ob-
16 jections either written or oral to the proposed removal of weeds , rubbish, refuse
and dirt were presented, and the hearing was closed on November 7, 1979.

4. The noxious and/or dangerous weeds growing in or upon or adjacent to real
18 property described in Resolution No . 1275 are seasonal and recurrent nuisances.
19 5. The superintendent is ordered to abate the nuisance declared by Resolu-
tion No. 1275 by having the weeds, rubbish, refuse and dirt removed, and for this
20 purpose the superintendent may enter upon private property to abate the nuisance,
and the superintendent is ordered to cause the abatement of the weeds from time-
21 to-time hereafter as the weeds recur per section 39562.1 of the Government Code.
Before the superintendent arrives, any property owner may remove the weeds, rub-
2 2 bish, refuse and dirt at his own expense.
- 23 6. The superintendent or the contractor awarded the work, as the case may be,
shall keen an account of the cost of abatement in front of or on each separate
24 parcel of' land where the work is done and modification and confirmation, an
itemized written report showing this cost, all as more particularly described by
05 Government Code section 39574.
26 MOVED, PASSED AND ADOPTED the 7th day of November 1979.
