A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JACINTO, A CALIFORNIA MUNICIPALITY, DE-
CLARING CERTAIN STREETS , SIDEWALKS AND PARCELS
OF PRIVATE PROPERTY AS PUBLIC NUISANCES , AND TO
41i BE SEASONAL AND RECURRENT NUISANCES DUE TO WEEDS.
5 NHEREAS the Superintendent of Public Works , having heretofore been desig-
nated by the body, to perform the duties imposed by Article 2 of Division 3 of
6 Title 4 of the Government Code , has submitted to this body evidence that noxious '
and dangerous weeds are growing uoon or adjacent to streets on land located in '
7 the City of San Jacinto, and that said weeds grow seasonally and recur from tine-
to-time; and

�1HERFAS the City Council elects to cause the abatement of said weeds under
9 the authority of Article 2 hereinabove cited;
0 NOW, THEREFORE , BE IT RESOLVED by the City Council of the City of San
Jacinto, state of California , in regular session assembled this

1 . That the City Council of said city finds that certain noxious and/or
dangerous weeds are growing upon or in front of land near streets , as hereinafter
13 described , that said noxious and/or dangerous weeds are a public nuisance and
i that the same are recurrent from time-to-time as a seasonal occurrence ,

1 2. The City Council therefore declares these weeds to be a public nji- i
15 , sance by authority granted to it by Section 39561 of the Government Code CL the
locations within the City of San Jacinto , County of Riverside , State of Cali -
1 r fornia , as described in Exhibit "A" affixed to this resolution which is incor-
porated herein by reference as fully and completely as if it were set forth at
length herein.
18 3. The City Clerk shall cause notice of this resolution together b with
1 notice of the time for hearing of objections to the findings herein to e mailed

as required by the provisions of Section 39567 . 1 of the Government Code.

OBJECTIONS AND DETERMINING TO PROCEED WITH ABATEMENT

The City Council adopted Resolution No. 1216 on May 16, 1978 , which by its
4 terms the Council elected to proceed under Government Code Sections 39501-39588
and did declare as a public nuisance all weeds growing upon streets , sidewalks
5 and private property in the city and all rubbish, refuse and dirt upon parkways , '
sidewalks and private property in the city; and

A public hearing was held on May 16, 1978; and no- objections to the proposed re-
7 moval of weeds, rubbish, refuse and dirt were made or presented either in writing
or orally;

NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED as follows :
1 . The foregoing is true.
10 2. The Council fixed May 16, 1978 at the hour of 7:30 p.m. in the Coun-
cil Chambers , as the time and place for hearing all objections to the proposed
removal of weeds , rubbish, refuse and dirt, and the director of public works was
designated as the person to perform the duties imposed by Government Code Sec-
tions 39560-39588 upon the superintendent, and he did prepare notices to destroy ,
131 and remove rubbish, refuse and dirt; the city did mail written notice of the pro-
posed abatement to all persons owning property described in Resolution No. 1216
in the time, form and manner prescribed by law.
14 3. The City Council did hold a public hearing on May 16, 1978, and no ob-
jections either written or oral to the proposed removal of weeds, rubbish, refus

and dirt were presented, and the hearing was closed on May 16, 1978.
4. The noxious and/or dangerous weeds growing in or upon or adjacent to
16 real property described in Resolution No. 1216 are seasonal and recurrent nui-
sances.
17 5. The superintendent is ordered to abate the nuisance declared by Resolu-
tion No. 1216 by having the weeds , rubbish , refuse and dirt removed and for this
18 purpose the superintendent may enter upon private property to abate the nuisance,
[ and the superintendent is ordered to cause the abatement of the weeds from time-
19 to-time hereafter as the weeds recur per Section 39562.1 of the Government Code.
I Before the superintendent arrives , any property owner may remove the weeds, rub-
20 bish, refuse and dirt at his own expense.
6. The superintendent or the contractor awarded the work, as the case may
21 : be, shall keep an accoutn of the cost of abatement in front of or on each sepa-
rate parcel of land where the work is done and modification and confirmation, e.
22 itemized written report showing this cost, all as more particularly described by
Government Code Section 30574,
