2 A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN JACINTO, CALIFORNIA, RELATING
3 TO PROCEDURE AND POLICIES CONCERNING APPLI-
CATIONS FOR REFUNDING OF FEES AND CHARGES

5 WHEREAS, various services and functions of the City staff, commissions-
6 ` and Council require the collection of fees and charges for processing; and
7 WHEREAS, all such fees and charges are designed to reimburse the City for
8 a portion of the actual cost of processing the related service; and
9 WHEREAS, as a general rule, the actual cost of the service willusually
10 equal or exceed theactual fee or charge collected even in those cases wherein
11 the application is terminated by the applicant prematurely; and
12 WHEREAS, the Council recognizes that in some particular cases the actual
13 fee or charge collected may exceed the 'cost of processing when prematurely
14 terminated by the applicant and in such cases desires to establish an equitable
15 procedure for refunds,
16 NOW, THEREFORE, BE IT RESOLVED'.
17 1 ; Whenever an applicant has terminated a proceeding within the City
18 for which a charge or fee has been collected, and in the opinion
19 of the applicant, the total fee or charge exceeds the cost of ser
20 vice provided to the date of termination, he may apply for a refund'
21 on a form provided by the City. Such application shall itemize and
22 identify all functions for which a fee or charge was paid, the total
23 fee or charge paid, the point of process wherein the termination oc
24 curred, and the portion or portions of the fee or charge which ex-
25 ceeds the cost of processing._
26 ! 2. Applications filed pursuant to this resolution shall be processed
27 !, through the City Manager's office to the City Council with recom-
28 ��` mendations.
29 �i 3. The City Council shall render a decision on the application which
30i may approve, deny or modify the request.
31 4. The decision of the City Council shall be final .
32 5. If any portion of this resolution shall be deemed invalid by;a court
