2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
San Jacinto , CALIFORNIA, DESIGNATING THE
3 COUNTY OF Riverside AS ITS AGENT FOR SERVICE OF
PROCESS FOR ANY AND ALL ACTIONS BROUGHT AGAINST
4 THE CITY OF San Jacinto UNDER DIVISION 1 ,
PART 91 CHAPTER 5, ARTICLE 2, SECTION 5140F ET.
5 SEQ. OF THE REVENUE AND TAXATION CODE.
6 WHEREAS the City of San Jacinto has been sued
7 under Division 1, Part 9, Chapter 51 Article 21 Section 5140, et.
8 seq. of the Revenue and Taxation Code for a refund of taxes in
9 actions naming the Board of Equalization of the State of California
10 and certain counties and cities, including the City of San Jacinto
11 as defendants; and
12 WHEREAS the Revenue and Taxation Code at Section 5149 has
13 provided for the defense of cities by County Counsel in actions
14 filed under said Division 1, Part 9, Chapter 5, Article 2 of the
15 Revenue and Taxation Code; and
16 WHEREAS Section 5149 of the Revenue and Taxation Code
17 provides that cities which seek representation by County Counsel
18 must designate the County as its agent for service of process; and
19 WHEREAS Section 5149 (b) directs the County Clerk to keep
20 a public record of such designation;
21 NOW, THEREFORE, BE IT RESOLVED as follows:
22 1 . The County of Riverside is hereby designated as agent
23 for service of process for the City of San Jacinto for
24 actions filed under Division 1, Part 9, Chapter 51 Article 2,
25 Section 5140, et seq. of the Revenue and Taxation Code.
26 2. The City Clerk shall transmit to the Clerk of the
27 Board of Supervisors, and to County Counsel, of the County of
28 Riverside a certified copy of this resolution.
