3 CERTIFICATE OF FINAL CANCELLATION OF
A PORTION OF A LAND CONSERVATION CONTRACT AND
4 DISESTABLISHMENT OF AN AGRICULTURAL PRESERVE .
5 ( Government Code Section 51281 . 1 )

G WHEREAS, Dale W. Reaser, entered into a Land
7 Conservation Contract with the County of Riverside ,
pursuant to the California Land Conservation Act of. 1965
8 ( Government Code Section 51200, et sea , ) which contract is
dated January 1, 1976, and was recorded February 26, 1976
9 as Instrument No . 24972 in the office of The County
Recorder of Riverside County, California; and,
10 WHEREAS, a petition has been filed by the Coast Valley
11 Company and Sykes Enterprises to cancel said contract and
to disestablish the Valle Vista Agricultural Preserve No ,
12 4, Map No . 332, and amended, pursuant to the special
provisions of Government Code Section 51281 . 1, and a public
13 hearing having been held by the Riverside County Board of
Supervisors on October 28 , 1986;
14 WHEREAS , in accordance with the California
15 Environmental Quality Act and the Riverside County Rules to
Implement CEQA, the matter was environt8entally assessed
1G (E . A. No . 30518 ) and a negative declaration was filed and
adopted upon a finding that the cancellation of a portion
17 of the contract and diminishment of the Valle Vista
Agricultural Preserve No . 4 , Map No . 332, as amended, will
18 not have a significant effect upon the environment; and,
10 WHEREAS, the landowner has proposed, if the
cancellation is approved, that the land be used for the
20 following alternative use : Tract Map No . 21564 , Amendment
No . 2, proposing 351 lots, and Change of Zone No . 4635,
21 proposing R-1 zoning; and,
22 WHEREAS, the County of Riverside, approved Tentative
Tract 21564 and Change of Zone 4635 .
23 WHEREAS, the amount of the cancellation fee, pursuant
to Section 51283 of the Government Code has been determined
24
and certified by the County Board to be $33, 919 . 00, and the
95 amount of the additional deferred taxes, pursuant to
Section 51283 , 1 of the Government Code has been determined
�G and certified by the County Board of Supervisors to be $0;
NOW, THEREFORE,
27 WHEREAS , subject property has subsequently been
28 annexed to the City of San Jacinto,
29 WHEREAS, the City Council of the City of San Jacinto
accepted Tract 21564 and Change of Zone 4635 as approved by
30 the County,
31 WHEREAS , the conditions with which the landowner was
required to comply with within one year at the recordation
32 of the tentative certificate of cancellation were :
a . Payment to the Treasurer of Riverside County of a
2 cancellation fee totalling $33,, 919 . 00

b. Approval. of Change of Zone No . 4635 by the Board
of Supervisors .

c . Recordation of final Map 21564 .

WHEREAS, the City Council. clarifies the intent of
6
condition C above as the approval of a development plan
which is Tentative Tract 21564 .
WHEREAS, the landowner has fullfilled the condition

prerequisite to the disestablishment of the Land
Conservation Contract as determined by the County of
Riverside
10 ! HE IT RESOLVED, FOUND AND DETERMINED by the City
Council of the City of San Jacinto, State of California, in
regular session assembled on May 3rd, 1.988, that :

1 . The cancellation of a portion of the
diminishment of the agricultural preserve, and the use of
the land for the proposed alternative use, is consistent
with the General Plan for the City of San Jacinto and will
14 not result in discontiguous patterns of urban development
for the following reasons : The oroDosed tract map and
15 change of zone propose lot sizes which are compatible with
area development and consistent with the City of San
Jacinto General Plan .
2 . The disestablishment of Valle Vista Agricultural
Preserve #4 Map 332 as Recorded on August 20, 1.975 is
18 final .
19� 3 . The Land Conservation Contract between Dale W.
Reeser and the County of Riverside,, dated January 1,, 1976,

120 and recorded February 26, 1976, as Instrument No. 24972 in
the Office of the County Recorder of Riverside County,
21 California, is cancelled, thereby removing from the effect
of said contract the real. property in the county of
22 Riverside, State of California, described in attached
23 Exhibit A,, which is made a part of this resolution .
BE IT FURTHER RESOLVED, FOUND, DETERMINED AND ORDERED
24 that the Clerk of this City Council. shall file and record
copies of this resolution in the Office of the County
251 Recorder of Riverside County, Californi'at and with the

MAP NO. 624
All of the real property in the County of Riverside, State of
California, described as follows .
Beginning at a point at the intersection of the southerly right of
way line of Washington Avenue and the easterly right of way line
of Cumberland Street; thence southerly alone said easterly right
of way to the northeasterly right of way line of Park Avenue.-
thence southeasterly on said northeasterly right of way to the
easterly right of way line of Elsinore ,Street; thence
northeasterly along said easterly right of way for a distance of
800 feet more or less to the north boundary line of the Lake Hemet
Water Company; thence south 45 degrees 7 feet east for a distance
of 352 feet; thence south 31 degrees 41 feet east for a distance
of 21.5 feet; thence south 68 degrees 21 feet east for a distance
of 260 feet.- thence north 88 degrees 05 feet east for a distance
of 120 . 14 feet to a point lying 780 feet west from the easterly
right of way line of Meridian Avenue; thence northerly 1, 652 . 09
feet to the southerly right of way line of Washington Avenue;
thence westerly along said southerly right of way to the point of
beginning.
