2 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINT09
3 CALIFORNIA, AWARDING THE CONTRACT FOR THE CONSTRUCTION OF
CERTAIN PUBLIC WORKS OF IMPROVEMENT IN A COMMUNITY FACILITIES
4 DISTRICT
5 THIS RESOLUTION IS ADOPTED WITH REFERENCE TO THE FOLLOWING
FACTSe
6 WHEREAS, at this time bids have been publicly opened , examined
and declared for certain of the proposed public works of
improvement and facilities as authorized for construction and
8 financing under proceedings for the formation of a Community
Facilities District pursuant to the terms and provisions of the
9 "Mello-Roos Community Facilities Act of 1982" , being Chapter
2.5, Part 1 , Division 2, Title 5 of the Government Code of the
10 State of California, in a community facilities district known
and designated as COMMUNITY FACILITIES DISTRICT NO. 2
11 (hereinafter referred to as the "District" ) .
12 NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City
of San Jacinto, in regular session, this 3rd day of
13 April 1990, as follows:
14 1 . The above recitals are all true and correct.
l5 2. That this legislative body hereby rejects all of said
proposals or bids except that herein mentioned , and does
16 hereby award the construction contract for doing said
work and making improvements in the Assessment District
17 to the lowest responsible bidder , to-wit :
18 Vido Samarzich, Inc.
19 at the prices named in the bid of said bidder on file
with the transcript of these proceedings and open for
20 public inspection.
1 3. That this award of contract is hereby conditioned upon
and made subject to the receipt of monies and proceeds
22 from the issuance and sale of bonds. The Contractor shall
not commence construction or order equipment until he has
23 received a Notice to proceed . Any progress payment to the
Contractor for work completed may be delayed if monies have
24 not been received from the sale of bonds .
25 4. That the works of improvement shall be constructed in the
manner and form as set forth in the plans and specifica-
26 tions for these proceedings, as previously approved .
27 5. That the Mayor and City Clerk are hereby authorized to
execute the Agreement for the works of improvement re-
28 lating to said District , and a copy of said Agreement
shall be on file with the transcript of these proceedings.
29 6. That all monies to pay for the costs and expenses of the
30 above referenced District shall be paid from the funds
as deposited in the Improvement Fund , including any
31 interest earned thereon.

2 7. The City Clerk shall certify to the adoption of this
Resolution.

MOVED, PASSED AND ADOPTED AT A REGULAR MEETING OF SAID CITY
4 COUNCIL DULY HELD THE 3rd DAY OF April 1990.
