HomeMy WebLinkAboutResolution - 1961 A RESOLUTION NO. 1961 a A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO, CALIFORNIA, APPROVING THE PRELIMINARY REPORT OF THE CITY MANAGER OF OF SAID CITY MADE PURSUANT TO THE REQUIREMENTS OF RESOLUTION NO. 1961 OF SAID CITY COUNCIL (San Jacinto Combined L & L Districts) THE CITY COUNCIL OF THE CITY OF SAN JACINTO DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City Council of the City of San Jacinto, California did in Resolution No. 1961 adopted June 4 , 1991, to the provisions of the "Landscaping and Lighting Act of 1972/1 of the State of California (Part 2 of Division 15 of the Streets and Highways Code of said State) , require the City Manager to make and file with the Clerk of the City Council a report in writing presenting certain matters relating to certain street lighting fixtures and appurtenances and proposed maintenance thereof, including the maintenance of all such fixtures and appurtenances throughout said Districts and to the maintenance of landscaping in various areas within said Districts as contemplated under the provision of said "Landscaping and Lighting Act of 1972; " and WHEREAS, said City Manager, pursuant to the requirements of said City Council as expressed in Resolution No. 1961 and of said law, did make on the loth day of July 1991 file in the office of the City Clerk (who is ex-officio Clerk of the City Council) of said City, her report in writing responsive to the requirements of said Resolution No. 1961 and of said law referred to in said Resolution No. 1961 and of said law referred to in said Resolution No. 1961 and as contemplated under the provision of said "Landscaping and Lighting Act of 1972; and WHEREAS, said City Clerk has presented the said report to the City Council of said City, and said Council has proceeded to carefully examine, inspect, consider and is satisfied with said report and with each and all of the items therein set forth; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JACINTO, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Resolution No. 1961 Page Two SECTION 1: That the report of the City Manager of the City of San Jacinto, California, bearing date the loth of July 1991, which said report was prepared and filed pursuant to the requirements of the provisions of Resolution No. 1961 of the City Council of said City, and in conformity with the provision of the "Landscaping and Lighting Act of 1972 , 11 of the state of California (Part 2 of Division 15 of the streets and Highways Code of said State) , and which said report was filed in the office of the City Clerk (who is ex-officio Clerk of the City Council) of the City of San Jacinto, California, on the loth day of July 1991, be and the same is hereby approved as so prepared, presented and filed. SECTION 2 : That the City Clerk shall certify to the passage and adoption of this Resolution, shall cause the same to be entered among the original resolutions of the City Council of said City and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted. Deputy City Clerk RESOLUTION NO. 1961 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO ORDERING THE CITY MANAGER TO PREPARE AND 2 FILE A REPORT IN ACCORDANCE WITH ARTICLE 4, CHAPTER 1, PART 2 , "LANDSCAPING AND LIGHTING ACT OF 1972" , 3 BEING DIVISION 15, STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA FOR THE FURNISHING OF 4 ELECTRICAL ENERGY AND MAINTENANCE OF STREET LIGHTS; AND FOR THE FURNISHING OF LANDSCAPING MAINTENANCE 5 IN "SAN JACINTO COMBINED LIGHTING AND LANDSCAPING DISTRICT" IN THE CITY OF SAN JACINTO, CALIFORNIA, 6 FOR THE FISCAL YEAR COMMENCING ON JULY 1, 1991 AND ENDING JUNE 30, 1992. ( SAN JACINTO COMBINED L & L DISTRICTS) 8 WHEREAS, the City Council of the City of San Jacinto , California 9 proposes to form an assessment district pursuant to the 10 "Landscaping and Lighting Act of 1972" , being Division 15 , 11 Part 2 of the Streets and Highway Code of the State of California; and 12 WHEREAS, the said assessment district shall include all parcels 13 of land within the said District and shall be designed as the 14 SAN JACINTO COMBINED LIGHTING AND LANDSCAPING MAINTENANCE DISTRICTS ; and 15 WHEREAS, it is proposed to furnish the electrical energy and 16 landscaping maintenance on the following streets as show on 17 San Jacinto Lighting and Landscaping Maintenance Plan No, 18 1990-91, also shown on attached Exhibits A, B, C , D, E, F & G, al street lights and landscaping maintenance areas within said 19 District , all as shown on Plan No, 1991-92 ; and 26 WHEREAS, it is proposed to furnish the energy and to maintain I the lighting system and to maintain the landscaping; 21 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JACINTO 22 DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: 23 SECTION 1. That the City Manager is hereby ordered to prepare 24 and file a report in accordance with Article 4 , Chapter 1, Part 2 , "Landscaping and Lighting Act of 1972 " , being Division 25 15 , Part 2 , Streets and Highway Code of the State of 26 California, for the furnishing of energy and the maintenance 27 of street lighting fixtures and appliances and Landscaping maintenance for the fiscal year commencing July 1, 1991, and 28 ending June 30 , 1992 , all as set forth in this resolution. 29 30 i 31 32 Resolution No. 1961 Page 2 1 SECTION 2_ That a certified copy of this resolution be 2 presented to said City Manager for her information and guidance. 3 SECTION 3.
