A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JACINTO, CALIFORNIA DECLARING THEIR INTENTION TO
ORDER ABANDONMENT OF CERTAIN STREET RIGHT OF WAY
DUE TO A REALIGNMENT OF EVANS STREET AT OLD
MOUNTAIN AVENUE, RESERVING UTILITY EASEMENTS, AND
NOTICING INTENT TO CONVEY THE VACATED PORTION
PURSUANT TO STREETS AND HIGHWAYS CODE SECTION 8356
WHEREAS, the easterly terminus of Evans Street does not intersect Old
Mountain Avenue at a right angle; and
WHEREAS, the intersection of Evans Street and Old Mountain Avenue was
realigned to intersect at a right angle pursuant to approval of Tract 26020; and
WHEREAS, the right of way required to facilitate this realignment of Evans Street
with Old Mountain Avenue was dedicated with the recordation of Tract 26020,
May 23, 1991 said dedication having been made by the developer, Old Mountain
Road Associates, A California Limited Partnership, in lieu of the portion of Evans
Street to be vacated; and
WHEREAS, it appears that there will be no public inconvenience suffered by the
vacation and abandonment of the aforesaid portions of Evans Street; and
WHEREAS, the City Council does hereby elect to proceed in this matter under
the provisions of Chapters 3, 5, and 6, Part 3 of Division 9 of the Streets and
Highways Code of the State of California;
NOW, THEREFORE, BE IT HEREBY RESOLVED AS FOLLOWS:
SECTION 1: The City Council of the City of San Jacinto,
California, does hereby declare its intent to vacate and
abandon certain portion of the public right-of-way
under and through the property as shown on attached
Exhibit "A", excepting therefrom any easement and
right to maintain, operate, replace, remove, or renew
public utility facilities in said portion; and
SECTION 2: A map of said right-of-way proposed to be vacated
and abandoned is on file in the office of the
Department of Community Development in the City
of San Jacinto to which reference is hereby made for
further particulars.
SECTION 3: That the City of San Jacinto does further declare its
intent, pursuant to Streets and Highways Section 8356,
to order that the portion vacated be conveyed by deed
to Old Mountain Road Associates, A California
Limited Partnership.
SECTION 4: Notice is hereby given to all persons interested
in or objecting to the proposed vacation and
abandonment that a hearing thereon will be
held at the City Council Chambers in the City
of San Jacinto located at 625 Pico Avenue, San
Jacinto, California, at 7:30 p.m., Tuesday,
November 19, 1991, which set time is not less
than fifteen (15) days from the adoption of this
Resolution.
SECTION 5: The City Clerk is directed to publish this resolution in
the manner prescribed by law for the publishing of
ordinances of the City and to post notices of vacation
conspicuously along the line of the property proposed
to be vacated at least fourteen (14) days before the
date hereinabove set for hearing, said notices shall be
posted and shall state that this resolution has been
adopted, and the time and place hereinabove set forth
for hearing thereon.
MOVED, PASSED and ADOPTED this 22nd day of October, 1991 by the
following vote:
AYES: Councilmembers Hafliger, Leahy, Richards , Boykin
NOES: None
ABSENT: Councilmember Ford
ABSTAIN: None
