A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN JACINTO,CALIFORNIA,AUTHORIZING EXTENDING
THE DATE TO DEFER PAYMENT OF FEES RELATED TO
ANNEXATION NO. 66 AMENDING RESOLUTION NO . 1937
WHEREAS, the City Council of the City of San Jacinto adopted
Resolution No. 1937 on the 7th day of May 1991, advancing the funds not previously
collected for completion of Annexation No. 66 to be repaid without penalty by September
17 1991, and to defer collection thereof to a time no later than the presentation of any
application for development, building, zoning, permit or any other discretionary action
requested by the property owner or developer; and
WHEREAS, Resolution No. 1937 established the deferred charges
based on the one-time fee of $78.00 per acre subject to an adjusted per acre fee at a rate
6 percent per anum, or the rate of increase in the consumer price index for all wage earners
and consumers in the Los Angeles area (whichever is greater) and an additional charge of
20 percent of the said per acre fee for administration collection and accounting costs
incurred by the City; and
WHEREAS, as of September 5, 1991, the property owners of proposed
Annexation No. 66 have paid a portion of their share of the reasonable estimated costs of
the project totalling $213,216.52 and the remaining balance of $234,728.12 had not been
paid; and
WHEREAS, the City is willing to extend the date of the advancement
of funds necessary for completion of the project to January 1, 1992, and at such time all
deferred fees shall be subject to an adjusted per acre fee at a rate 6 percent per anum, or
the rate of increase in the consumer price index for all wage earners and consumers in the
Los Angeles area (whichever is greater) and an additional charge of 20 percent of the said
per acre fee for administration collection and accounting costs incurred by the City.
NOW, THEREFORE, the City Council of the City of San Jacinto
resolves as follows:
1. The City agrees to extend the date of the deferment of fees and
advancement of funds necessary for completion of the project to be repaid without penalty
by January 1, 1992.
2. In the event any property owner fails to pay
the fee imposed by January 1, 1992, City agrees that such fee may
be deferred to a date no later than the presentation of any
application for development, building, zoning, permit or any other
discretionary action requested by the property owner or developer
and at such time all deferred fees shall be subject to an adjusted
per acre fee at a rate 5 percent per anum, or the rate of increase
in the consumer price index for all wage earners and consumers in
the Los Angeles area (whichever is greater) and an additional
charge of 20 percent of the said per acre fee for administration
collection and accounting costs incurred by the City.
