HomeMy WebLinkAboutResolution - 2017 RESOLUTION NO : 2017 A RESOLUTION OF THE CITY OF SAN JACINTO, CALIFORNIA, ESTABLISHING AND ADJUSTING RATES FOR THE COLLECTION OF GARBAGE AND RUBBISH COLLECTED WITHIN THE CITY OF SAN JACINTO RECITALS WHEREAS, pursuant to Public Resources Code Section 49300, the terms and conditions for the collection of refuse is a matter of local concern and is subject to such proscriptions as may be made by the City Council, and WHEREAS, by Resolution 91-566, dated October 29, 1991, the Board of Supervisors did increase the tipping fee at County landfills from $23 . 00 per ton to $31. 50 per ton, effective January 1, 1992 . Said increase will result in an increase of $1. 12 per month for residential service and $. 56 per cubic yard per month for commercial service, and WHEREAS, pursuant to the City° s franchise contract with O.K. & Associates, any County landfill charge increases shall be passed through to the user, and WHEREAS, pursuant to AB 939 (Public Resources Code Sections 41000, et. seq. ) the City was required to prepare and submit a source reduction and recycling element. In furtherance of such requirement, the City was required to and did retain as City° s consultant, KLEINFELDER, INC. , and has and will expend the sum of $42 , 000. 00 for such consulting services. In order to re-coup the sum paid for such consulting services, over a period of one year, an additional charge to existing service must be assessed in the sum of $. 35 per month for residential service, and $.23 per cubic yard per month for commercial service. NOW, THEREFORE, THE CITY COUNCIL FOR THE CITY OF SAN JACINTO DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1: This resolution supersedes Resolution No. 1976, adopted the 2nd day of July, 1991. EFFECTIVE JANUARY 1, 1992 SECTION 2 : Residential refuse collection service shall be increased by the sum of $1. 12 per month per residential unit. Commercial and bin service rates shall be increased by the sum of $. 56 per cubic yard per month. The increases stated in this section shall not be included for the computation of City° s franchise fee payable from the franchisee/hauler. Actual total rates inclusive of all charges shall be as shown on the attached Exhibit "A" . SECTION 3 : Effective January 1, 1992 and ending December 31, 1992 , residential and commercial refuse collection shall be further increased by the sum of $. 35 per month for residential service and $. 23 per cubic yard per month for commercial/bin service. The increase shown in this section shall be payable to the City of San Jacinto for costs incurred for consultation services in the implementation of AB 939. No charge shall be made thereon for franchise fees payable to City from franchisee/hauler. SECTION 4: Mobilehome parks having refuse picked up at each space but for which fees are billed to and paid by the operator shall be charged on the same basis as other single family residential service. Other mobilehome parks shall be charged the commercial rate if refuse is collected at central locations, or the residential rates for individual collection with individual billing as for other single family residential service. SECTION 5: The City Council may provide that rubbish not included within the definition of either "garbaget1 or "waste" , as provided in Section 13 .68. 010 of the Municipal Code be collected by the City for such charge the City Manager or other officer of the contracting party so authorized by the City Council may determine to be fair and proper in each individual case. SECTION 6: This rate resolution shall become effective for the trash and refuse billing, effective January 1, 1992 . SECTION 7: The City Council does so resolve pursuant to the authority vested in it by the provisions of Section 13 . 68. 140 of the San Jacinto Municipal Code.
