RDA 96-4 RESOLUTION OF THE SAN JACINTO REDEVELOPMENT AGENCY APPROVING THE NEGATIVE DECLARATION FOR AMENDMENT NO. 3 TO THE REDEVELOPMENT PLAN FOR THE SAN JACINTO REDEVELOPMENT PROJECT WHEREAS, the City Council of the City of San Jacinto, California (the "City Council") did duly pass and adopt Ordinance No. 754 on June 28, 1983, and did thereby adopt and approve the Redevelopment Plan for the San Jacinto Redevelopment Project (the "Redevelopment Plan"); and WHEREAS, Amendment No. 1 to the Redevelopment Plan was ,approved by the City Council by Ordinance No. 992 which was duly passed and adopted on December 28, 1993, which, among other things added certain territory to the boundaries of the San Jacinto Redevelopment Project(the "Project Area"); and WHEREAS, on December 20, 1994, the City Council adopted Ordinance No. 1006 and thereby amended the Redevelopment Plan in order to conform to the requirements of Section 33333.6 of the Community Redevelopment Law, California Health and Safety Code Sections 33000, et seq. (the "CRL") (the Redevelopment Plan as amended by Amendment No. 1 and Ordinance No. 1006 will be referred to herein as the "Amended Redevelopment Plan"); and WHEREAS, the San Jacinto Redevelopment Agency (the "Agency") has prepared the Amendment No. 3 to the Amended Redevelopment Plan ("Amendment No. 3"), and has filed its report on said Amendment No. 3; and WHEREAS, the purpose of Amendment No. 3 is to delete certain territory from the boundaries of the Project Area; and WHEREAS, the Agency has prepared a Negative Declaration (the "Negative Declaration") on the proposed Amendment No. 3 (the "Project") pursuant to the California Environmental Quality Act, Public Resources Code Sections 21000, et seq. ("CEQA"), and the Guidelines for Implementation of the California Environmental Quality Act, Title 14, California Code of Regulations, Sections 15000, et seq. (the "CEQA Guidelines"); and WHEREAS, all actions required to be taken by applicable law related to the preparation, circulation, and review of the Negative Declaration have been taken; and WHEREAS, pursuant to notice duly given, the City Council and the Agency have held a full and fair public hearing on the proposed Amendment No. 3 and the Negative Declaration; and WHEREAS, the Agency has independently reviewed and considered the Negative Declaration for the proposed Amendment No. 3, and all comments and responses thereto. NOW, THEREFORE, THE SAN JACINTO REDEVELOPMENT AGENCY HEREBY RESOLVES AS FOLLOWS: SECTION 1. A full and fair public 'hearing has been held on the Negative Declaration prepared for the proposed Project. The Agency has considered all comments received thereon, and the responses thereto. These actions .having been taken, the Negative Declaration is hereby approved as the Negative Declaration for the Project and is incorporated herein by reference. SECTION 2. The Agency hereby finds that the scope of development expected for the Redevelopment Plan is substantially anticipated in the San Jacinto General Plan. SECTION 3. The Agency hereby finds that the Negative Declaration for the proposed Project has been completed in compliance with CEQA and the CEQA Guidelines, and that the Agency has reviewed and considered the Negative Declaration and the information contained therein prior to deciding whether to approve the proposed Project and finds that the Negative Declaration reflects the independent judgment of the Agency. SECTION 4. The Agency hereby finds that on the basis of its review of the Initial Study, the Negative Declaration, and the comments on the Draft Negative Declaration and Initial Study, that there is no substantial evidence in light of the whole record before the Agency that the Project may have a significant effect on the environment. SECTION 5. The Executive Director of the Agency, in cooperation with the City Clerk of the City of San Jacinto, is hereby authorized and directed to file with the County Clerk of the County of Riverside, a Notice of Determination, pursuant to 14 California Code of Regulations Section 15075, upon the approval of Amendment No. 3.
