RESOLUTION NO. RDA 94-5
A RESOLUTION OF THE SAN JACINTO REDEVELOPMENT
AGENCY AUTHORIZING THE SALE OF REAL PROPERTY
WITHIN THE SAN JACINTO REDEVELOPMENT PROJECT AREA
PURSUANT TO DISPOSITION AND DEVELOPMENT AGREEMENT
(DEVELOPER: METROPOLITAN THEATRES CORPORATION)
WHEREAS , the San Jacinto Redevelopment Agency ( the
"Agency" ) wishes to encourage the rehabilitation of land and
buildings within its Project Area for the elimination of blight .
The encouragement of the construction of new commercial , retail
and entertainment uses within the Project Area will encourage
and promote a more secure financial climate within the Project
Area , create job opportunities , secure attractive and quality
construction , and provide needed retail and entertainment
opportunities to citizens within the Project Area ; and
WHEREAS, the San Jacinto Redevelopment Agency owns
approximately 6. 5 acres of land described as Lots 1 , 2 and
4 of Parcel Map 19362, Rook 122 , pages 57 and 58 of Parcel
Maps , Records of Riverside County and Agency , and now desires to
convey 5. 5 acres of said property ( the "Site" ) to Metropolitan
Theatres Corporation ( the "Developer" ) pursuant to the terms of a
Disposition and Development Agreement between the Agency and
_Developer , to provide for the construction of a multiplex theatre ;
and
WHEREAS, the proposed use cf the Site , as contemplated
in the Agreement , is within the permitted uses and applicable
zoning of the property and furthers the goals of the Redevelop-
ment Plan; and -
WHEREAS, California Community Redevelopment Law requires
the preparation of a report documenting and summarizing the reason ,
basis , terms and effects of the sale as they may relate to the
elimination of blight , for properties originally obtained with tax
increment monies , and for the approval by the city Council of San
Jacinto ; and
WHEREAS, the City Council of the City of San Jacinto has
concurrently herewith approved the conveyance by the Agency , pur-
suant to Section 33433 of the Health and Safety Code ; and
WHEREAS , a public hearing , duly published and noticed ,
was held on June 28 , 1994 , at which time evidence was received
and objections , if any , considered :
NOW, THEREFORE, IT IS HEREBY RESOLVED by the San Jacinto
Redevelopment Agency as follows :
Section 1 . The facts stated in the above recitals are
found to be true and correct and all proceedings herein have been
conducted in accordance with applicable law and procedure .

Section 2. The San Jacinto Redevelopment Agency
does hereby approve the sale of the within described property
in accordance with the terms and conditions stated within the
Disposition and Development Agreement , which is concurrently and
hereby approved .
Section 3 . The San Jacinto Redevelopment Agency hereby
finds as true , the content and representations of the Report ,
presented at the hearing by the Agency' s Staff . In furtherance
thereof , the Agency specifically makes the following findings :
a . The conveyance of the within described
property as proposed in the Disposition
and Development Agreement , will assist in
the elimination of blight .
b . The consideration for the sale is not less
than the fair market value of the property
at the use and with the covenants and
conditions and development costs authorized
by the sale and the Disposition and Develop-
ment Agreement.
MOVED, PASSED AND ADOPTED this 28th day of June , 1994 ,
upon the following vote :
