A RESOLUTION OF THE SUCCESSOR AGENCY TO THE
REDEVELOPMENT AGENCY OF THE CITY OF SAN JACINTO
AUTHORIZING SUCCESSOR AGENCY STAFF TO EXECUTE ANY
AND ALL NECESSARY DOCUMENTS ASSOCIATED WITH THE
TRANSFER OF THE DOWN PAYMENT ASSISTANCE GRANTS AND
THE HOUSING REHABILITATION LOANS FROM THE SUCCESSOR
AGENCY TO THE HOUSING AUTHORITY IDENTIFIED IN THE
AMENDED HOUSING ASSET TRANSFER FORM
WHEREAS, pursuant to Health and Safety Code Section 34173(d), the City of
San Jacinto elected to serve as Successor Agency to the dissolved San Jacinto
Redevelopment Agency ("Successor Agency"), confirmed by Resolution No. 3408
adopted on January 9, 2012; and
WHEREAS, pursuant to Health and Safety Code section 34176, the City of San
Jacinto, as the Successor Agency elected not to retain the housing assets and functions
previously performed by the Redevelopment Agency of the City of San Jacinto, and
instead elected to transfer all rights, powers, assets, liabilities, duties and obligations
associated with the housing activities of the Redevelopment Agency of the City of San
Jacinto, excluding any amounts on deposit in the Low and Moderate Income Housing
Fund, to the San Jacinto Housing Authority ("Housing Authority"), as provided in
Resolution No. 3410 adopted on January 27, 2012; and
WHEREAS, AB 1 X 26 included language that all property transfers after January
1 , 2011 were void, but the bill included language that would allow the Oversight Board
to direct the Successor Agency to transfer all the housing assets to the appropriate
entity; and
WHEREAS, On August 1, 2013, the Oversight Board as the Successor Agency's
oversight board pursuant to Health and Safety Code Section 34179(a) approved an
amended housing asset transfer form as set forth in Resolution No. OB 13-08.
NOW, THEREFORE, THE SUCCESSOR AGENCY OF THE
REDEVELOPMENT AGENCY OF THE CITY OF SAN JACINTO DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. Recitals. The Recitals set forth above are true and correct and are
incorporated into this Resolution by this reference.
SECTION 2. Authorization. The Successor Agency hereby authorizes and
directs Successor Agency staff, to execute any and all necessary documents
associated with the transfer of the down payment assistance grants and the housing

rehabilitation loans from the Successor Agency to the Housing Authority as identified in
the amended housing asset transfer form ("Amended HAT') attached as Exhibit "A".
SECTION 3. Severability. If any provision of this Resolution or the application of
any such provision to any person or circumstance is held invalid, such invalidity shall
not affect other provisions or applications of this Resolution that can be given effect
without the invalid provision or application, and to this end the provisions of this
Resolution are severable. The Successor Agency declares that the Successor Agency
would have adopted this Resolution irrespective of the invalidity of any particular portion
of this Resolution.
SECTION 4. Certification. The Agency Secretary of the Successor Agency shall
certify to the adoption of this Resolution.
SECTION 5. Effective Date. This Resolution is effective immediately upon
approval of the Amended HAT by the Department of Finance or the running of the time
for the Department of Finance to challenge the Amended HAT, whichever occurs first.
