OB 13-08 COUNTY OF RIVERSIDE ) ss CITY OF SAN JACINTO A RESOLUTION OF THE OVERSIGHT BOARD OF THE SUCCESSOR AGENCY TO THE REDEVELOPMENT AGENCY OF THE CITY OF SAN JACINTO APPROVING THE AMENDED HOUSING ASSET TRANSFER FORM WHEREAS, pursuant to Health and Safety Code Section 34173(d), the City of San Jacinto elected to serve as Successor Agency to the dissolved San Jacinto Redevelopment Agency ("Successor Agency"), confirmed by Resolution No. 3408 adopted on January 9, 2012; and WHEREAS, the Oversight Board is the Successor Agency's oversight board pursuant to Health and Safety Code Section 34179(a); and WHEREAS, pursuant to Health and Safety Code section 34176, the City of San Jacinto, as the Successor Agency elected not to retain the housing assets and functions previously performed by the Redevelopment Agency of the City of San Jacinto, and instead elected to transfer all rights, powers, assets, liabilities, duties and obligations associated with the housing activities of the Redevelopment Agency of the City of San Jacinto, excluding any amounts on deposit in the Low and Moderate Income Housing Fund, to the San Jacinto Housing Authority ("Housing Authority"), as provided in Resolution No. 3410 adopted on January 27, 2012; and WHEREAS, AB 1X 26 included language that all property transfers after January 1, 2011 were void, but the bill included language that would allow the Oversight Board to direct the Successor Agency to transfer all the housing assets to the appropriate entity; and WHEREAS, a follow up bill regarding the dissolution of redevelopment agencies, AB 1484, was signed by the Governor on June 27, 2012. This bill added the Health and Safety Code Section 34176 (a) (2) requirement that the entity assuming the housing functions of the former redevelopment agency provide a list of assets transferred between February 1 , 2012 and the date upon which the list was created. This Housing Asset Transfer form was required to be submitted to the DOF by August 1, 2012. The down payment assistance grants, including related affordability covenants (collectively the "Grants") were inadvertently not listed on the prior Housing Assets Transfer Form ("Form") submitted to the California Department of Finance on July 31, 2012 for the period February 1, 2012 through July 31, 2012; and WHEREAS, AB 1484 also required the Successor Agency to hire a licensed accountant to complete a Due Diligence Review (DDR) to be completed and submitted to the County Auditor-Controller, the State Controller's Office, and the Department of Finance per Health and Safety Code Section 34179.6. The DDR was completed, held 1 24438.K0000\815 805 3.3 for public review, and then considered for approval by the Oversight Board on December 17, 2012; and WHEREAS, as part of this Due Diligence Review, the accountant identified 19 transfers which were the Grants (for Down Payment Assistance) for a total of $183,996 from January 1 , 2011 to January 31, 2012 which were inadvertently left off the list of DOF-approved housing asset transfers between February 1 , 2012 and July 30, 2012; and WHEREAS, all Down Payment Assistance Grants issued by the former Redevelopment Agency between December 1, 2009 and January 31 , 2012 totaled $478,647.45; and WHEREAS, the Oversight Board finds that the Grants are proper housing assets and as such should be included on an amended housing asset transfer list to be submitted to the Department of Finance. NOW, THEREFORE, THE OVERSIGHT BOARD OF THE SUCCESSOR AGENCY TO THE SAN JACINTO REDEVELOPMENT AGENCY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Recitals. The Recitals set forth above are true and correct and are incorporated into this Resolution by this reference. SECTION 2. CEQA Compliance. The approval of the Amended Housing Asset Transfer Form through this Resolution does not commit the Oversight Board to any action that may have a significant effect on the environment. As a result, such action does not constitute a project subject to the requirements of the California Environmental Quality Act. SECTION 3. Approval of the Amended Housing Asset Transfer Form. The Oversight Board hereby approves the Amended Housing Asset Transfer form, revising the form to include the Grants listed on Page 18 (Attachment 3.A) of the Due Diligence Review plus other similar Grants not listed, identifying items that need to be transferred to the San Jacinto Housing Authority. The Amended Housing Asset Transfer Form is attached as Exhibit A to the Resolution. SECTION 4. Implementation. The Oversight Board hereby directs the Successor Agency to submit an Amended Housing Asset Transfer Form to the Department of Finance. SECTION 5. Assignment and Assumption. The Oversight Board hereby authorizes and directs the Successor Agency, through its staff, to take all reasonably necessary steps to effectuate the assignment and transfer of these grants from the Successor Agency to the Housing Authority including executing all documents necessary to perfect title. 2 24438.K000W158053.3 SECTION 6. Severability. If any provision of this Resolution or the application of any such provision to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution that can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are severable. The Oversight Board declares that the Oversight Board would have adopted this Resolution irrespective of the invalidity of any particular portion of this Resolution. SECTION 7. Certification. The City Clerk of the City of San Jacinto, acting on behalf of the Oversight Board as its Secretary, shall certify to the adoption of this Resolution. SECTION 8. Effective Date. Pursuant to Health and Safety Code Section 34179(h), all actions taken by the Oversight Board may be reviewed by the State of California Department of Finance, and, therefore, this Resolution shall not be effective for five (5) business days, pending a request for review by the State of California Department of Finance.
