A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN JACINTO, CALIFORNIA, APPROVING TENTATIVE
PARCEL MAP NO. 36206, A SUBDIVISION OF FIVE
PARCELS CONSISTING OF 2 COMMERCIAL PARCELS, 1
INDUSTRIAL PARCEL, 1 RESIDENTIAL PARCEL, AND 1
PARK PARCEL LOCATED SOUTH OF RAMONA
BOULEVARD, EAST AND WEST OF BRIDGE ROAD, AND
NORTH OF DE ANZA DRIVE: FILE NO. TPM 36206.
WHEREAS, San Jacinto SAMF, LLC filed an application on 24 October
2011 for Tentative Parcel Map 36206 which would create five parcels consisting
of 2 commercial parcels, 1 industrial parcel, 1 residential parcel, and 1 park
parcel ("Application") on 49.99 acres located generally south of Ramona
Boulevard, east and west of Bridge Road and north of De Anza Drive and more
particularly described in Exhibit 'A' ("Subject Site");
WHEREAS, the property affected by the Application is located within the
following proposed zoning districts: RMH, OSR, CG, and IL ZONING
DISTRICTS;
WHEREAS, the Application was reviewed, studied, and found to comply
with the California Environmental Quality Act ("CEQA") as more fully described
below; and
WHEREAS, on 25 October 2012, the Planning Commission of the City of
San Jacinto ("Planning Commission") conducted a duly noticed public hearing on
the Amendment at which time all persons wishing to testify in connection with the
Amendment were heard and the Amendment was fully studied; and
WHEREAS, all other legal prerequisites to the adoption of this Resolution
have occurred.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SAN JACINTO:
Section 1. Based on the entire record before the City Council, all written
and oral evidence presented to the City Council, and the findings made by this
Resolution, the City Council of the City of San Jacinto approves Tentative Parcel
Map 36206, as depicted in the attached Exhibit 'F', subject to the conditions of
approval in Exhibit "G" ("Tentative Parcel Map 36206").
SECTION 2. Pursuant to California Government Code Section 66410 et
seq., based on the entire record before the City Council and all written and oral
evidence presented to the City Council, the City Council finds, as follows:
A. The proposed subdivision, and the provisions for its design and
improvement, are consistent with the general plan for the City of
San Jacinto ("General Plan") because:
1. The Tentative Parcel Map 36206 provides for land uses
compatible with the Community Commercial (CC), Manufacturing
(M), Medium High Density Residential (MHDR), and Park (P) land
use classifications for the Subject Site in the General Plan, and the
provisions for design and improvements promote the goals and
objectives of the General Plan for the following reasons:
a. The proposed project implements a significant improvement to
local circulation by establishing the alignments and improving
Bridge Road and Ramona Boulevard that will further improve area
circulation.
b. The proposed project implements surface drainage
improvements, including detention facilities, that will maintain
downstream surface water flows at or below existing undeveloped
rates.
c. The proposed project includes a parcel for the expansion of
Colonel Millett Park.
B. The Subject Site is physically suitable for the types and density of
development proposed in Tentative Parcel Map 36206 because
infrastructure services are readily available to support the proposed
development and constraints relating to seismicity have been
mitigated to a level of insignificance.
C. The subdivision and improvement proposed in Tentative Parcel
Map 36206 are not likely to cause substantial environmental
damage nor substantially injure fish or wildlife or their habitat
because no development will occur in any significant habitat of rare
or endangered species of plant, wildlife, or insect, or any fragile or
unique biotic community.
D. The subdivision design and type of improvements proposed in
Tentative Parcel Map 36206 are not likely to cause serious public
health problems because all development and public improvements
will be performed per the requirements of all applicable standards
and codes, including zoning and building codes.
E. The subdivision design and type of improvements proposed in
Tentative Parcel Map 36206 will not conflict with easements
acquired by the public at large for access through or use of the
Subject Site because easements have been reserved through
subdivision design, converted to public dedications, or easement
relocation.
Section 3. Pursuant to California Government Code Section 66412.3, based on
the entire record before the City Council and all written and oral evidence
presented to the City Council, the City Council finds the subdivision and
improvements proposed in Tentative Parcel Map 36206 help the City of San
Jacinto meet its regional housing needs because it:
1. Attains decent housing within a satisfying living environment for
households of a broad range of socio-economic, racial, age, and ethnic groups in
San Jacinto.
2. The proposed development offers a balanced residential development
with access to employment opportunities, goods and services, community
facilities, and adequate public services.
Section 4. Based on the entire record before the City Council and all written and
oral evidence presented to the City Council, the City Council finds the nature and
extent of the dedications, reservations, impact fees, and other exactions are
reasonably related to public needs and roughly proportional to the impacts
created by the subdivision and improvements proposed in Tentative Parcel Map
36206 because:
1 . Fees are assessed equally city-wide; and
2. Fee credits are available to offset costs of public improvements that are
constructed as part of the proposed development.
Section 5. Based on the entire record before the City Council and all written and
oral evidence presented to the City Council, the City Council finds that the project
described in Tentative Parcel Map 36206 is the same that was analyzed in the
Mitigated Negative Declaration and that all necessary environmental review for
Tentative Parcel Map 36206 has been completed in compliance with the
California Environmental Quality Act for the following reasons:
An environmental analysis has been conducted which evaluated
information and impacts based on the specifics of the proposed project. This
analysis determined that the proposed project has the potential to have a
significant effect on the environment, but mitigations have been identified to
reduce these potential effects to a level of insignificance. Therefore, a Mitigated
Negative Declaration and its associated Mitigation Monitoring Plan is
recommended.
Section 6. The location and custodian of the document and any other material
which constitute the record of proceedings upon which the Planning Commission
based its decision is as follows: Planning Director, City of San Jacinto Planning
Department, 595 S. San Jacinto Avenue, San Jacinto, CA 92583. (951) 487-
7330.
Section 7. Effective Date. This Resolution shall become effective on the date on
which Ordinance 12-13 for Change of Zone 1-11 becomes effective.
