GPA 1-11 WHEREAS, local governments are authorized by Government Code section 65350 et seg., to prepare, adopt, and amend general plans; and WHEREAS, the proposed amendment to the Land Use element of the City of San Jacinto General Plan ("Amendment') initiated by San Jacinto SAMF, LLC for property proposed to be developed as Ramona 49, Tentative Parcel Map 36206, Conditional Use Permit 6-11, and Conditional Use Permit 7-11 from Medium Density Residential and Gateway Specific Plan to Community Commercial, Industrial, Medium High Density Residential, and Park implements the overall goals and policies of the General Plan and leaves the General Plan internally consistent; and WHEREAS, the proposed Amendment was sent to affected public entities for their review and comment as part of the environmental documents prepared for this matter; and WHEREAS, the Amendment was reviewed, studied, and found to comply with the California Environmental Quality Act ("CEQA") as more fully described below; and WHEREAS, on 25 October 2012, the Planning Commission of the City of San Jacinto ("Planning Commission") conducted a duly noticed public hearing on the Amendment at which time all persons wishing to testify in connection with the Amendment were heard and the Amendment was fully studied; and WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN JACINTO: Section 1. Based on the entire record before the City Council, all written and oral evidence presented, and the findings made by this Resolution, the City Council of the City of San Jacinto approves the Amendment to the General Plan involving 49 acres of property described in the attached legal description, Exhibit 'A', and depicted in the attached Exhibit 'B' to the General Plan Land Use map and to designate said property as "Community Commercial", "Industrial", "Medium High Density Residential", and "Park". Section 2. Based on the entire record before the City Council and all written and oral evidence presented, the City Council finds that the Amendment promotes the goals and objectives of the General Plan and leaves the General Plan a compatible, integrated, and internally consistent statement of policies for the following reasons: A. The Amendment is integrated and compatible with the Land Use Element in that it provides an appropriate orientation and relationship between land uses within and adjacent to the Subject Site, and the property associated with this request is an integral and necessary part of the proposed development. C. The Amendment is integrated and compatible with the Community Services and Facilities Element in that the proposed development will participate in the City's Development Fee program to maintain adequate levels of police and fire protection; provide land for expansion of Colonel Millett Park; provide an orderly and comprehensive water and sewer system that assures adequate service, conservation of water resources, and use of reclaimed water; expands the use of communication, natural gas, and power with minimal visual and environmental impacts; and provides private park and recreational facilities that will be used by all ages of the project's population. D. The Amendment is integrated and compatible with the Circulation Element of the General Plan in that improvements will be made to the San Jacinto circulation system in coordination with major improvements in the area by Cal Trans and RCTC; establishes the alignments, roadways, sidewalks, and parkway landscaping that will enhance the visual character of the area and improves area circulation. Uses within the project will generate traffic which will use the internal circulation system of the project without exceeding the capacity of that system. E. The Amendment is integrated and compatible with the Resource Management Element by providing a system of walking trails to recreational areas serving the residential land uses within the project; planting native trees and drought tolerant vegetation; assuring that adequate water supply is available for the development; providing opportunities for groundwater recharge from on-site detention basins, promoting water conservation through the use of reclaimed water for landscaping within detention basins; executing a Treatment and Disposition Agreement to address potential cultural resources on the project site; and identifying mitigation measures to offset impacts relating to air quality greenhouse gas emissions, and energy conservation. F. The Amendment is integrated and compatible with the Public Safety Element in that it provides an appropriate land use distribution and orientation which protects the community from unreasonable risks associated with seismic, geologic, and flood hazards because the development has addressed flooding issues, and will be subject to seismic standards due to strong ground shaking potential. G. The Amendment is integrated and compatible with the Noise Element in that noise attenuation measures have been incorporated into project design. H. The Amendment is integrated and compatible with the Housing Element in that it provides for development consistent with the existing housing and projected housing needs of the community and region because it implements Housing Element Policy 3.3 by providing development of attractive and safe housing to meet community needs in a manner that is not contrary to any other Housing Goals and Policies. Section 3. Based on the entire record before the City Council and all written and oral evidence presented, the City Council finds that the Amendment complies with CEQA for the following reasons: An environmental analysis has been conducted which evaluated information and impacts based on the specifics of the proposed project. This analysis determined that the proposed project has the potential to have a significant effect on the environment, but mitigations have been identified to reduce these potential effects to a level of insignificance. Therefore, a Mitigated Negative Declaration and its associated Mitigation Monitoring Plan is adopted. Section 4.
