NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JACINTO RESOLVES AS FOLLOWS: Page 1 of 3 SECTION 1 . Based on the entire record before the City Council, all written and oral evidence presented to the Council, and the findings set forth in this Resolution, the Council hereby adopts the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Plan to allow the construction of the above-referenced project on the Subject Site, subject to the mitigation measures contained in the Initial Study and Mitigation Monitoring and Reporting Plan for the Project. SECTION 2. The City Council has reviewed and considered the environmental documentation for the project prior to taking action. Based on the analysis contained in the Initial Study ad the accompanying environmental information, the Council finds as follows: A. There is no substantial evidence of potentially significant environmental impacts and a Mitigated Negative Declaration has been prepared. B. The City has complied with the California Environmental Quality Act (CEQA). C. The action by the City Council to adopt the Mitigated Negative Declaration reflects the independent judgment of the City. SECTION 3. Based on the entire record before the City Council and all written and oral evidence presented, including the staff report, the Council hereby finds that: A. The project is consistent with the General Plan objectives, policies and programs. B. The project will not adversely affect the public health, safety, and welfare. C. The project will not adversely affect the environment. D. The nature and extent of the installation of Line H segment Master Drainage Plan improvements is reasonably related to public needs and roughly proportional to the impacts created by use of the Subject Site. SECTION 4. Based on the entire record before the City Council and all written and oral evidence presented, the Council finds the installation of Line H segment Master Drainage Plan improvements complies with CEQA for the following reason: Although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because revisions in the project or mitigation measures incorporated into the conditions of approval for the project would avoid the effects and no significant effects would occur; therefore, A MITIGATED NEGATIVE DECLARATION has been prepared for adoption by the City Council. City Staff is directed to file a Notice of Determination within 5 days of adoption by the City Council. SECTION 5. Effective Date. This Resolution shall become effective on the date on which it is approved by the City Council.
