CUP 8-10 (APN 434-070-033). WHEREAS, Hansen McCoy investment group filed an application on November 2, 2010 for Conditional Use Permit No. 8-10 for a 32 unit apartment complex, located on the southwest side of Idyllwild Drive east of State Street (APN 434-070-033), and more particularly described in Exhibit "A" ("Site Plan"); WHEREAS, the property affected by the Application is zoned R-3 Multi- Family Residential; WHEREAS,the Application was reviewed, studied, and found to comply with the California Environmental Quality Act ("CEQA") as more fully described below; WHEREAS, on July 17, 2012 the COUNCIL of the City of San Jacinto ("City Council') conducted a duly noticed public hearing on the Application, at which time all persons wishing to testify in connection with the Application were heard and the Application was comprehensively reviewed; and WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. NOW,THEREFORE,THE CITY COUNCIL OFTHE CITY OF SAN JACINTO RESOLVES AS FOLLOWS: SECTION 1. Based on the entire record before the City Council, all written and oral evidence presented to the City Council, and the findings set forth in this Resolution, the City Council approves Conditional Use Permit No. 8-10, subject to the conditions of approval in the staff report. SECTION 2. Based on the entire record before the Council and all written and oral evidence presented to the City Council, including the staff report, the Council finds as follows: A. The Subject Site for which the CUP is granted is in accordance with the objectives of the City of San Jacinto Development Code and the purposes of the multiple-family residential (R-3) zoning district because the City Council has determined that the use of the subject property for the construction of 32 apartments is similar to and no more objectionable than any other Conditional Uses allowed with in the multiple-family residential (R-3) zoning district. B. The CUP is consistent with the general plan of the City of San Jacinto (General Plan), will not be detrimental to the public health, safety, or welfare, and will not be materially injurious to properties or improvements in the vicinity because: 1. The CUP provides for land uses compatible with the High Density Residential land use classification for the Subject Site in the General Plan Land Use Element. 2. The construction of 32-unit apartment complex authorized by the CUP helps to develop a balanced residential environment with access to employment opportunities, community facilities and adequate services. C. The traffic generated by the proposed conditional use will not overload the capacity of the surrounding street system and will not create a hazard to public safety because excess capacity exists in the current system. SECTION 3. Based on the entire record before the City Council and all written and oral evidence presented, including the staff report, the City Council finds the nature and extent of the dedications, reservations, impact fees, and other exactions are reasonably related to public needs and roughly proportional to the impacts created by use of the Subject Site as permitted by the CUP. SECTION 4. Based on the entire record before the City Council and all written and oral evidence presented, the City Council finds the CUP complies with CEQA for the following reasons: The project is considered to be a Class 32 Categorical Exemption (In-fill Development Project) pursuant to Section 15332 of the California Environmental Quality Act Guidelines. The project therefore is exempt from CEQA. PASSED, APPROVED AND ADOPTED, this 17th day of July, 2012. SECTION 5. The location and custodian of the documents and any other material which constitute the record of proceedings upon which the City Council based its decision is as follows: Community Development Department, City of San Jacinto Planning Department, 595 S. San Jacinto Ave., San Jacinto, CA 92683, 951-487-7330. SECTION 6. Effective Date. This Resolution shall become effective upon its adoption.
