A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY
OF SAN JACINTO APPROVING THE DISPOSITION AND
DEVELOPMENT AGREEMENT BETWEEN THE SAN JACINTO
REDEVELOPMENT AGENCY AND ROBERT E. DORAN
WHEREAS, the Redevelopment Agency of the City of San Jacinto ("Agency") is
engaged in activities necessary to execute and implement the redevelopment plan
("Redevelopment Plan") for the San Jacinto Redevelopment Project Area ("Project
Area"); adopted by Ordinance No. 754 on June 28, 1983, as it has been amended from
time to time; and
WHEREAS, by donation and conveyance from the City of can Jacinto, the
Agency intends to become the fee simple owner of certain real property which two
parcels of real property consisting of approximately two (2) acres generally located at
915 Industrial Way and west and adjacent to 915 Industrial kNay, within the City of San
Jacinto ("Property") and which are legally described in the attached Exhibit A; and
WHEREAS, the Property is located within the Project Area; and
_WHEREAS, the Agency and Robert E. Doran, an individual ("Developer'') have
negotiated the terms of a Disposition and Development Agreement ("Agreement") which
provides, among other things, for the Agency's conveyance to Developer of that portion
of the Property located at 915 Industrial Way and for Developer's non-binding right to
negotiate to purchase that portion of the Property adjacent to 915 Industrial Way, upon
certain terms and conditions; and
WHEREAS, the Agreement's substantive terms and conditions have been
presented to , and considered and approved by the Agency's governing board; and
WHEREAS, Section 33430 of the California Community Redevelopment Law
(Health & Safety Code 33000, et seq.) ("CRL") authorizes the Agency to sell or lease
real property for redevelopment purposes; and
WHEREAS, CRL Section 33431 requires the Agency to hold a duly noticed
public hearing before making a y sale pursuant to CRL Section 33430 without public
bidding; and
WHEREAS, pursuant to CRL Section 33431, the Agency held a duly noticed
public hearing on May 2, 2002, concerning the approval of the proposed Agreement;
and

WHEREAS, the Agency has determined that pursuant to Section 21000 of the
California Environmental Quality Act ("CEQA') and State CEQA Guidelines that the
Rnai Program Environmental Impact Report ("EIR") prepared and certified for the
Redevelopment Plan adequately included and considered the impacts of redevelopment
in the Project Area and imposed adequate mitigation measures. As such, the Agency
has determined that no supplemental EIR, negative declaration, mitigated negative
declaration, EIR addendum or other subsequent report is required to be prepared and
filed for approval of the Agreement.
NOW, THEREFORE, THE REDEVELOPMENT AGENCY OF THE CITY OF
SAN JACINTO CALIFORNIA DOES RESOLVE AS FOLLOWS:
Section 1. The Agency approves the Agreement in substantially the form
presented to the Agency, a copy c€which is on file with the Agency
Secretary.
Section 2. The Agency Executive Director is authorized to execute the
Agreement on behalf of the Agency, together with such non-
substantive changes and amendments as may be approved by the
Agency Executive Director and Agency Counsel. The Agency
Executive Director is authorized to take any action and execute any
and all documents and agreements necessary to implement the
Agreement.
Section 3. The Agency, as the lead agency under CEQA, directs Agency staff to
file a Notice of Determination with the County Clerk of Riverside
County within three (3) working days following the approval of the
resolution.
Section 4. This resolution shall take effect immediately upon its adoption.
PASSED, APPROVED AND ADOPTED this 2nd day of May, 2002 by a 5/0 vote.
