HomeMy WebLinkAboutResolution - 2314 RESOLUTION NO. 2314 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO, CALIFORNIA, SUMMARILY VACATING STREET DEDICATION LOT NOS. 26 AND 27 OF TRACT 27797 ALONG WESTERN VILLAGE DRIVE PURSUANT TO STREETS AND HIGHWAYS CODE SECTION 8330 ET SEQ. WHEREAS, on May 21 , 1984, the City of San Jacinto ("City") accepted a dedication of right of way from Mr. Carl H. Quandt for the construction of a public cul-de- sac. which was never constructed; and WHEREAS, on August 11, 1993, the City's Planning Commission approved the subdivision of Tentative Tract Map 27797, which partially re-subdivided parcels formerly created through Tract 8319, and 18568, that included Mr. Carl H. Quandt's irrevocable offer to dedicate for future cul-de-sac construction along Western Village Dive; and WHEREAS, the approval of Tentative Tract Map 27797 did not include the construction of cul-de-sac along the westerly portion of Lots 26 and 27 of such subdivision; and WHEREAS, on July 19, 2001, the City Council approved the recordation of Final Tract Map 27797, and did not include the construction of a cul-de-sac along the westerly portion of Lots 26 and 27 of Tract 27797; and WHEREAS, Final Tract Map 27797 was recorded on August 3, 2001, as Instrument in Book 307 of Maps, at Page 22-24, at the request of the City Clerk of the City of San Jacinto as Instrument No. 2001-367712, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Jacinto: Section 1. The City Council of the City of San Jacinto determines that the property depicted by Exhibit "A" attached hereto and incorporated by reference hereby is not required for street or highway purposes and said street shall be offered back to the owner, his.heks, Successors, cr assigns, and zhnl!! be samm€.Iy vacated in accvrdance with Section 8335 of Chapter 4 of Part 3 of Division 9 of the California Streets and Highways Code, excepting therefrom public utility easements for the purposes cited in Section 8340(a) of the California Streets and Highways Code. Section 2. The City Clerk shall cause a certified copy of this Resolution, attested by the City Clerk under seal, to be recorded without acknowledgment, certificate of acknowledgment, or further proof in the Office of the Riverside County Recorder. Section 4. This Resolution shall be effective upon its adoption.
