A RESOLUTION OF THE CITY OF SAN JACINTO APPOINTING
BARRY MCCLELLAN TO THE OFFICE OF CITY CLERK OF THE CITY
OF SAN JACINTO
WHEREAS, the office of City Clerk is currently vacant and must be filled immediately to
provide certain duties necessary for the continued operation of City government; and
WHEREAS, due to the need for efficiency in City administration, the City of San Jacinto
("City") desires to provide for the appointment by the City Council of the City Manager to
the office of City Clerk; and
WHEREAS, there is no legal prohibition against the appointment of the same person to
the offices of City Manager and City Clerk under California law; and
WHEREAS, the City Council has adopted an Urgency Ordinance providing for the
amendment of Chapters 2.12 and 2.20 of the San Jacinto municipal Code to expressly
authorize the appointment of the city manager to the office of City Clerk,
NOW, THEREFORE, BE IT RESOLVED the City of San Jacinto hereby resolves
as follows:
SECTION 1. The City Council finds and declares as follows:
Effective upon taking the Oath of Office, Barry McClellan (Employee), City
Manager of the City of San Jacinto, shall be and hereby is appointed City
Clerk of the City of San Jacinto. Employee shall be authorized to, and
shall perform the functions and duties of the City Clerk under California
law and as further specified in the Municipal Code of the City of San
Jacinto and such other legally permissible and proper duties and functions
SECTION 2. The City Council hereby authorizes the City Attorney to draft any
necessary amendment to the Employee's employment contract with the
City to provide for separate compensation for Employee's performance of
the duties of the City Clerk. The Mayor shall be and is hereby authorized
to sign the amendment on behalf of the City.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council
on the 16th day of April 2009 by the following vote.
