GPA 3-07. WHEREAS, local governments are authorized by Government Code section 65350 et seg., to prepare, adopt and amend general plans; and WHEREAS, the proposed amendment to the Land Use element of the City of San Jacinto General Plan ("Amendment") initiated and prepared by Mario Zamorano located on the west side of Kirby Street north of Esplanade Avenue from Low Density Residential to Medium Density Residential implements the overall policies and goals of the General Plan and leaves the General Plan internally consistent; and WHEREAS, the proposed Amendment was sent to affected public entities for their review and comment; and WHEREAS, the Amendment was reviewed, studied, and found to comply with the California Environmental Quality Act ("CEQA") as more fully described below; and WHEREAS, on January 22, 2009, the City Council of the City of San Jacinto ("City Council") conducted a duly noticed public hearing on the Amendment at which time all persons wishing to testify in connection with the Amendment were heard and the Amendment was fully studied; and WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN JACINTO: SECTION 1. Based on the entire record before the City Council, all written and oral evidence presented, and the findings made in this Resolution, the City Council of the City of San Jacinto approves the Amendment to the General Plan as set forth in the attached Exhibit "A" graphic. SECTION 2. Based on the entire record before the City Council and all written and oral evidence presented, the City Council finds the Amendment promotes the goals and objectives of the General Plan and leaves the General Plan a compatible, integrated, and internally consistent statement of policies for the following reasons: A. The Amendment is integrated and compatible with the Land Use Element in that it provides an appropriate orientation and relationship between land uses within and adjacent to the Subject Site, and promotes orderly development beyond the Subject Site's boundaries, because the residential land use is compatible with the General Plan, and is compatible with the residential designation for the properties to the west and north, where residential tracts have already been approved and developed. B. The Amendment is integrated and compatible with the Circulation Element in that the density and distribution of uses within the Subject Site will generate traffic, which is anticipated and provided for in the Circulation Element because the site is accessed by Kirby Street, with Esplanade Avenue to the south and Seventh Street to the north. In addition, the residential tract proposed is less than what could be developed under the proposed designation (36 lots versus 50 lots). C. The Amendment is integrated and compatible with the Housing Element in that it provides for development consistent with the existing and projected housing needs of the community and region because the Housing Element Policy of providing "a variety of housing opportunities by type, tenure, and cost to households throughout the City" by providing for medium density development in this area of the city which was not previously available. D. The Amendment is integrated and compatible with the Conservation Element in that the proposed residential development will promote the orderly conservation, development, and utilization of natural resources as in-lieu fees will be paid. E. The Amendment is integrated and compatible with the Open Space Element in that 0.35 acres of the project are set aside as a private park, which is consistent with the adopted goals and policies for preserving and managing open space within the City and do not create conflicts to the realization of said goals and policies. F. The Amendment is integrated and compatible with the Noise Element in that it provides a pattern of land uses that minimizes the exposure of community residents to excessive noise, because the proposal utilizes existing streets, and provides a landscaped buffer along Kirby Street to minimize noise exposure from vehicles on this street. G. The Amendment is integrated and compatible with the Safety Element in that it provides an appropriate land use distribution and orientation which protects the community from unreasonable risks associated with seismic, geologic, flood and wildfire hazards because the site is not located in a high fire hazard area, seismic zone or is subject to flooding with the improvements proposed. SECTION 3. Based on the entire record before the City Council and all written and oral evidence presented, the City Council finds the Amendment complies with CEQA for the following reasons: Although the proposed project could have had a significant effect on the environment, there will not be a significant effect in this case because revisions in the project or proposals made by or agreed to by the applicant would avoid the effects to a point where clearly no significant effects would occur; therefore, A MITIGATED NEGATIVE DECLARATION has been prepared. City Staff is directed to file a Notice of Determination within 5 days of this project approval. SECTION 4. The location and custodian of the documents and any other material which constitute the record of proceedings upon which the City Council based its decision is as follows: Community Development Department, City of San Jacinto Planning Department, 595 S. San Jacinto Avenue, San Jacinto, CA 92583. (951) 487-7330. SECTION 5. Effective Date. This Resolution shall become effective upon its adoption.
