FT. FOUR BEDROOM MANUFACTURED HOME ON 2.36 ACRES. THE SITE IS LOCATED IN THE SINGLE FAMILY RESIDENTIAL, (R-1) ZONE AT 2220 GIRARD ST. (APN 439-160-022 and 042): FILE NO. CUP 04-92 AMENDMENT 1. WHEREAS, La Vista Recovery Center filed an application on December 11, 2008, File No. CUP 4-92, Amendment 1, for a Conditional Use Permit Amendment to increase the maximum number of residents from 30 to 37, and to add an 1,800 sq. ft. four bedroom manufactured home on 2.36 acres parcel, APN 439-160-022 and 439-160-042 ("Subject Site"), and more particularly described in Exhibit "A"; and WHEREAS, the property affected by the Application is zoned R-1 (Single Family Residential); and WHEREAS, on April 2, 2009, the City Council of the City of San Jacinto ("Council") conducted a duly noticed public hearing on the Application at which time all persons wishing to testify in connection with the Application were heard and the application was comprehensively reviewed; and WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JACINTO RESOLVES AS FOLLOWS: SECTION 1. Based on the entire record before the City Council, all written and oral evidence presented to the City Council, and the findings set forth in this Resolution, the City Council approves Conditional Use Permit 04-92 Amendment 1, as shown on Exhibit "A" and subject to the conditions of approval in the staff report. SECTION 2. Based on the entire record before the Council and all written and oral evidence presented to the Council, the Council finds the Conditional Use Permit is consistent with the purpose and intent of the Single Family Residential (R-1) zoning district because: 1. The proposed location of the Conditional Use is in accord with the objectives of Article 4 of the Zoning Ordinance (Ordinance 340) and the purposes of the zone in which the site is located. The site is zoned R-1 purposes of the zone in which the site is located. The site is zoned R-1 (Single Family Residential). The proposed expansion of the recovery center is located in proximity to existing and proposed residential uses. Therefore, the use is consistent with the goals and objectives of the R-1 zoning district. Furthermore, the expansion of the recovery facility is permitted as an expansion of a non-conforming use per Zoning Ordinance Article 19, Section 19.09 (1)(b) and Article 8C, Section 3(F). The existing CUP has been in effect for over 30 years. With a site area occupied by the existing use of 66,646 square feet, the proposed expansion of 1,800 square feet would be an increase of 2.7% over the existing use, which is well under the 10% in any five year period permitted in Article 19, Section 19.09 (1) (b). Landscaping, parking, and screening have been provided in accordance with the appropriate Articles in the Zoning Ordinance. The proposed location of the Conditional Use and the conditions under which it would be operated or maintained will not be detrimental to the public health safety or welfare, or materially injurious to properties or improvements in the vicinity. As stated above the project is consistent with the zone classification for the site and the land use element of the General Plan. Further, the project has been reviewed by City and County agencies and has been conditioned accordingly. Follow up inspections by the City of San Jacinto will be done as needed to ensure public health, safety and welfare. 3. The proposed conditional use will comply with each of the applicable provisions of Article 17 of the Zoning Ordinance. The use is consistent with the intent and purposes of Ordinance 340 and applicable provisions of the General Plan by providing additional community care opportunities not previously available. The circulation system in the area has the capacity to absorb the anticipated traffic generated by this development because excess capacity exists in the current system. SECTION 3. Based on the entire record before the Council and all written and oral evidence presented to the Council, the Council finds the Conditional Use Permit complies with CEQA for the following reasons: This proposal has been determined to be a Class 32 (Infill Development Project) Categorical Exemption, pursuant to Section 15332 of the Guidelines for Implementation of CEQA; therefore A Notice of Exemption has been prepared. City Staff is directed to file a Notice of Exemption within 5 days of project approval.
