A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO
APPROVING THE TRANSFER OF TITLE FOR THE PROPERTIES
LOCATED AT 181 E. MAIN STREET AND 201 E. MAIN STREET FROM
THE CITY OF SAN JACINTO TO THE REDEVELOPMENT AGENCY OF
THE CITY OF SAN JACINTO
WHEREAS, California Government Code Section 37350 provides that a city
may purchase, lease, receive, hold, and enjoy real and personal property, and control and
dispose of it for the common benefit; and
WHEREAS, Section 33220 of California Community Redevelopment Law
(Health &Safety Code 33000, et seq.)("CRL")authorizes the City of San Jacinto("City')to
dedicate, sell, convey or lease any of its property to a redevelopment agency, upon the
terms and with or without consideration, as it determines, for the purpose of aiding and co-
operating in the planning, undertaking, construction, or operation of redevelopment projects
located within the City; and
WHEREAS, the City is the owner of certain real properties located at 181 E.
Main Street(APN: 437-046-010) and 201 E. Main Street(APN: 437-045-020) both legally
described in Exhibit A attached hereto and incorporated herein by reference("Properties");
and
WHEREAS, the City desires to transfer the Properties to the Redevelopment
Agency of the City of San Jacinto ("Agency') for which future compensation shall be
provided to the Agency as permitted under Health and Safety Code Section 33396; and
WHEREAS, the Agency desires to obtain the Properties in orderto demolish
the existing structures on the sites, including a former city hall and museum, for the
purpose of future redevelopment of the Properties as authorized under Health and Safety
Code Section 33420; and
WHEREAS, the demolition of blighted structures on the Properties and the
future redevelopment of this Properties shall result in a common benefit to the citizens of
the City; and
WHEREAS, pursuant to California Government Code Section 65402, the
Planning Commission of the City ("Planning Commission") has determined that the
location, purpose and the transfer of title for the Properties are in conformance with the
City's general plan; and

WHEREAS, City staff has determined that the City's transfer of title for the
Properties to Agency is exempt from the requirements of the California Environmental
Quality Act("CEQA"), pursuant to State CEQA Guidelines Section 15061(b)(3), because it
can be seen with certainty that the mere transfer of title to the Properties from the City to
the Agency will not have a significant effect on the environment; and
WHEREAS, pursuant to the foregoing, the City staff has determined that a
notice of exemption ("Notice of Exemption")for transfer of title for the Properties should be
filed pursuant to CEQA,the State CEQA Guidelines and the City's Local CEQA Guidelines;
and
WHEREAS, all other prerequisites to the adoption of this resolution
("Resolution") have occurred.
NOW, THEREFORE, THE CITY OF SAN JACINTO RESOLVES AS
FOLLOWS:
Section 1. The City Council hereby finds that the City's transfer of title for
the Properties to the Agency will result in the Properties being made available for future
redevelopment purposes as authorized by CRL, and such transfer shall result in a common
benefit to the citizens of the City.
Section 2. The City Council hereby approves the City's conveyance of the
Properties to the Agency pursuant to the terms and conditions set forth in the grant deed
("Grant Deed") attached hereto as Exhibit B.
Section 3. The City Council hereby authorizes the City Managerto execute
a grant deed in substantially the form as Exhibit B attached hereto and incorporated by
referenced herein, and to take such other actions and execute such other documents as
may be necessary to accomplish the transfer of title for the Properties in accordance with
this Resolution.
Section 4. The City Council hereby directs City staff to file a Notice of
Exemption with the Clerk of Riverside County within five (5) calendar days following
approval of this Resolution.
Section S. This Resolution shall take effect upon its adoption by the City.
