A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JACINTO, CALIFORNIA, APPROVING BOND FOR CITY CLERK
WHEREAS, California Government Code section 36518 provides that before
entering upon the duties of City Clerk, the City Clerk shall "execute a bond to the city",
and that the penal sum of the bond shall be "in a reasonable amount recommended by
the city attorney and fixed by the city council'; and
WHEREAS, San Jacinto Municipal Code, section 2.20.010 provides, "The city
clerk of the city shall furnish to the city a bond in the penal sum of five thousand dollars
($5,000), for the performance of his or her official duties as required by law"; and
WHEREAS, Government Code section 36520 further provides that "The city
council shall approve all bonds. When approved, the clerk's bond shall be filed with the
mayor"; and
WHEREAS, City Manager Barry McClellan recently took on the additional
position of City Clerk; and
WHEREAS, as City Clerk, Mr. McClellan recognized his duty to obtain a bond in
the amount of $5,000.00, and on June 24, 2009 Mr. McClellan obtained such bond to
fulfill that obligation.
NOW, THEREFORE, BE IT RESOLVED determined and ordered by the City
Council of the City of San Jacinto:
SECTION 1. The City Council of the City of San Jacinto hereby approves the
bond dated as of June 24, 2009 and presented on August 6, 2009
on behalf of Mr. Barry McClellan.
SECTION 2. The City Clerk shall certify as to the adoption of this resolution.
This resolution shall be effective immediately upon adoption.
PASSED, APPROVED and ADOPTED, this 6th day of August, 2009 by the
following vote:
Ayes: Ayres, Di Memmo, Mansperger, Potts, Stubblefield
Nays: None
Absent: None
Abstain: None
