GPA 03-08. WHEREAS, local governments are authorized by Government Code section 65350 et seq., to prepare, adopt and amend general plans; and WHEREAS, the proposed amendment to the Land Use element of the City of San Jacinto General Plan ("Amendment') initiated and prepared by Shelbran Investments proposes to re-designate 13 acres of real property located at the southwest comer of Ramona Expressway and Cawston Avenue, commonly described as Assessor Parcel Number 430-100-017, (the "Subject Site") as Community Commercial (CC); and WHEREAS, the Subject Site is currently designated under the Land Use Element of the City of San Jacinto General Plan as Gateway Area Specific Plan (SP-G) Overlay; and WHEREAS, the proposed Amendment implements the overall policies and goals of the General Plan and leaves the General Plan internally consistent because the proposed commercial land use designation for the Subject Site is compatible with the proposed development of that portion of the Gateway Area, as such area is designated in the General Plan; and WHEREAS, the proposed Amendment was sent to affected public entities for their review and comment; and WHEREAS, the Amendment was reviewed, studied, and found to comply with the California Environmental Quality Act ("CEQA") as more fully described below; and WHEREAS, on April 23, 2009, the Planning Commission of the City of San Jacinto conducted a duly noticed public hearing on the Amendment at which time all persons wishing to testify in connection with the Amendment were heard and the Amendment was fully studied, and recommended to the City Council for approval; and WHEREAS, on May 21, 2009, the City Council of the City of San Jacinto ("City Council") conducted a duly noticed public hearing on the Amendment at which time all persons wishing to testify in connection with the Amendment were heard and the Amendment was fully studied; and WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN JACINTO: SECTION 1. Based on the entire record before the City Council, all written and oral evidence presented, and the findings made in this Resolution, the City Council approves the Amendment to the General Plan as set forth in the attached Exhibit "A" graphic. SECTION 2. Based on the entire record before the City Council and all written and oral evidence presented, the City Council finds that the Amendment promotes the goals and objectives of the General Plan and leaves the General Plan a compatible, integrated, and internally consistent statement of policies for the following reasons: A. The Amendment is integrated and compatible with the Land Use Element in that it provides an appropriate orientation and relationship between land uses within and adjacent to the Subject Site, and promotes orderly development beyond the Subject Site boundaries, because the commercial land use is compatible within the Gateway Area, as designated in the General Plan. B. The Amendment is integrated and compatible with the Circulation Element in that the distribution of uses within the Subject Site will generate traffic, which is anticipated and provided for in the Circulation Element because the site is bounded by Ramona Expressway and Cawston Avenue. C. The Amendment is integrated and compatible with the Housing Element because residential housing was not anticipated on the project site so the current housing element will not be impacted nor will the Housing Element update. D. The Amendment is integrated and compatible with the Conservation Element in that the future commercial development will use water-efficient landscaping and hardscape to reduce the need for water. E. The Amendment is integrated and compatible with the Open Space Element in that the project would not increase the need for additional parks. F. The Amendment is integrated and compatible with the Noise Element in that it provides a pattern of land uses that reduces the exposure of community residents to excessive noise, because the proposal utilizes existing and proposed streets. G. The Amendment is integrated and compatible with the Safety Element in that it provides an appropriate land use distribution and orientation which protects the community from unreasonable risks associated with seismic, geologic, flood, and wildfire hazards because the site is not located in a high fire hazard area or seismic zone, and is subject to special building standards for the floodplain of the San Jacinto River in which the site is located. SECTION 3. Based on the entire record before the City Council and all written and oral evidence presented, the City Council finds the Amendment complies with CEQA for the following reasons: Although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because revisions in the project or mitigation measures incorporated into the conditions of approval for the project would avoid the effects and no significant effects would occur; therefore, a MITIGATED NEGATIVE DECLARATION has been prepared. City Staff is directed to file a Notice of Determination within 5 days of this project approval. SECTION 4. The location and custodian of the documents and any other material which constitute the record of proceedings upon which the City Council based its decision is as follows: Planning Director, City of San Jacinto Planning Department, 595 S. San Jacinto Avenue, San Jacinto, CA 92583. (951) 487- 7330. SECTION 5. Effective Date. This Resolution shall become effective upon its adoption.
