HomeMy WebLinkAboutResolution - 2296 RESOLUTION NO. 2296 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO, CALIFORNIA, COMMUNITY FACILITIES DISTRICT NO. 2, APPROVING THE ANNUAL SPECIAL TAX LEVY FOR COMMUNITY FACILITIES DISTRICT NO. 2 WHEREAS, the City Council of the City of San Jacinto has initiated proceedings, held a public hearing, conducted and election and received a favorable vote from the qualified electors relating to the levy of a special tax in a community facilities district, and as authorized pursuant to the terms and provisions of the "Mello-Roos Community Facilities Act of 1982", being Chapter 2.5, Part 1 , Division 2, Title 5 of the Government Code of the State of California: and WHEREAS, the City Council, by ordinance as authorized by section 53340 of the Government Code of the State of California, has authorized the Community Facilities District, and the City Council is desirous to establish the specific rate of the Special Tax A to be collected for the next fiscal year for repayment of the bonds issued to finance certain improvements within Community Facilities District No. 2, replenishment of the bonds' reserve fund and costs of administering the bonds and the Special Tax B to be collected for the next fiscal year for Police and Fire services; NOW, THEREFORE, BE IT RESOLVED as follows: SECTION 1: That the above recitals are all true and correct. SECTION 2: That the specific rate and amount of the special tax to be collected to pay for the costs and expenses for Fiscal Year 2001-2002 for the District is hereby determined and established for Special Tax A as set forth in Exhibit "A," and for Special Tax 6 as set forth in Exhibit "C", of that certain document entitled "Attachments for Tax Roll Resolutions; Council Meeting 81212001" attached hereto and incorporated herein by this reference. SECTION 3: That the rate set forth above does not exceed the amount as previously authorized by Ordinance of the City Council, and is not in excess of that as previously approved by the qualified electors of the District. SECTION 4: That the proceeds of the special tax shall be used to pay, in whole or in part, the costs and expenses associated with the bonds issued to finance certain improvements and to pay, in whole or part, the costs and expenses of authorized Police and Fire services within the District. The proceeds of the special taxes shall be used as set forth and shall not be used for any other purpose. SECTION 5: The special tax shall he collected in the same manner as ordinary ad valorem property taxes are collected, and shall be subject to the same penalties and the same procedure and sale in cases of any delinquency for ad valorem taxes, and the Tax Collector is hereby authorized to deduct reasonable administrative costs incurred in collecting any said special tax. SECTION 6: All monies collected shall be paid into the funs and accounts established in connection with Community Facilities District No. 2. SECTION 7: The Auditor-Controller of the County of Riverside is hereby directed to enter in the next County assessment roll on which taxes will become due, opposite each lot or parcel of land affected in a space marked public improvement, special tax or by any other suitable designation, the installment of the special tax, and for the exact rate and amount of said tax as set forth in Exhibit "B" for Special Tax A, and Exhibit "D" for Special Tax B, of the previously referenced "Attachments for Tax Roll Resolutions; Council Meeting 8/212001." SECTION 8: The County Auditor-Controller shall then, at the close of the tax collection period, promptly render to the City a detail report showing the amount and/or amounts of such special tax installments, interest, penalties and percentages so collected and from what property collected, and also provide a statement of any percentage retain for the expense of making any such collection. The County Auditor-Controller/County afRiverside agrees to enter all assessments, fees, charges or taxes for the City upon receipt of such roll on or about August 9, 2001 based upon such certification. The City shall be solely liable and responsible, and will defend, indemnify and hold the County and this ofce harmless from any liability as a result of claims or claims for refunds and related interest due filed by taxpayers against any assessments, fees, charges or taxes placed on the roll for the City by the County. Article XIII C. Sec. 2 c "Any general tax imposed, extended or increased, without voter approval, by any local government on or after January 1, 1995, and prior to the effective date of this article, shall continue to be imposed only if approved by a majority vote of the voters voting in an election on the issue of the imposition, which election shall be held within two years of the effective date of this article and in compliance with subdivision (b). Article XIII D. Sec. 5 "...this article shall become effective the day after the election unless otherwise provided. Beginning July 1, 1997, all existing, new, or increased assessments shall comply with this article. " Article XIII D. In addition, an amount may be added to replenish the Reserve Fund for any amounts used as a result of delinquent special taxes. To the extent moneys are on deposit in the Reserve Fund in excess of the Reserve Requirement, such excess will be allocated towards the September 1, 2001 debt service payment.
