A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN JACINTO DECLARING AN EMERGENCY AND
DELEGATING AUTHORITY TO THE CITY MANAGER TO
ORDER ACTIONS REQUIRED TO REPAIR SALLEE PARK
POOL WITHOUT SOLICITING BIDS PURSUANT TO
PUBLIC CONTRACT CODE SECTION 22050
WHEREAS, Section 22050 of the Public Contract Code governs emergency
contracting procedures applicable to the City of San Jacinto;
WHEREAS, the San Jacinto City Council ("City Council") finds that
emergency conditions exist regarding Sallee Park Pool, within the City of San Jacinto;
WHEREAS, the City Council finds that the emergency conditions do not allow
time for solicitation of bids;
WHEREAS, the City Council finds that repair work is necessary to respond to
the emergency conditions which exist at Sallee Park Pool in order to remedy the
emergency.
BE IT NOW THEREFORE RESOLVED AS FOLLOWS:
1. John F. Wager Jr, City Manager, is delegated the authority to order the
materials and labor to repair dangerous conditions present at Salle Park fool, within the
City of San Jacinto, without soliciting competitive bids and to take any further actions
authorized by Section 22050 of the Public Contract Code to respond to the emergency.
2. The City Manager, or his designee, shall report the project status to
the City Council at each regularly scheduled City Council meeting during the course of the
project, and the City Council shall determine whether to continue the project, by a
four/fifths vote, until the emergency project is either terminated by the City Council or
completed.
ADOPTED, SIGNED AND APPROVED at a regular meeting of the City
