NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JACINTO RESOLVES AS FOLLOWS- SECTION 1 . Based on the entire record before the Council, all written and oral evidence presented to the Council, and the findings set forth in this Resolution, the Council denies Conditional Use Permit No. 6-00, which sought to allow a material recovery and transfer facility for municipal solid waste on the Subject Site. New SECTION 2. Based on the entire record before the Council and all written and oral evidence presented to the Council, the Council finds as follows: A. The use for which the CUP is proposed is not in accordance with the objectives of the City of San Jacinto Zoning Ordinance and the purposes of the M-1, Light Manufacturing, zoning district. The M-1 zone is designed to "...encourage sound industrial development...by providing and protecting an environment exclusively for such development, subject to regulations necessary to insure the purity of air and water in the San Jacinto Valley area, and the protection of nearby residential, commercial and industrial uses of lands from hazards and from noise or other radiated disturbances. The proposed project is not in accordance with the San Jacinto Zoning Ordinance and the objectives of the M-1 zone for the following reasons: 1. Evidence presented at the public hearing indicates that the proposed facility cannot be operated in a manner to prevent the creation of nuisance conditions such as odors, noise and excessive traffic. 2. Evidence presented at the public hearing indicates that the uncovered green waste will generate odors affecting surrounding properties during those periods when the waste has not been removed or during those periods when rain and winds impact the chemical decomposition of the - waste. 3. Evidence presented at the public hearing indicates that the uncovered green waste and the use of gas and electrical-powered chippers and shredders will generate noise beyond acceptable levels in the surrounding area. 4. Evidence presented at the public hearing indicates that the use of large and heavy transfer trucks coupled with the unknown direction of future traffic flows coming to the facility will create incompatible traffic patterns and street conditions in the surrounding street system and will negatively impact the surrounding area. B. The use for which the CUP is proposed is not consistent with the Industrial land use designation of the General Plan, which requires "industrial uses to co-exist with surrounding land uses...not to generate adverse amounts of pollution," and "...to provide adequate buffering to prevent incompatibilities between the industrial use and surrounding properties." The proposed project is not in accordance with the Industrial Land Use Designation of the General Plan for the following reasons: w low t . Evidence presented at the public hearing indicates that the proposed facility has the potential to generate the creation of excessive odor and noise from the outdoor green waste processing area which would be developed pursuant to a site plan that lacks adequate buffering measures, such as a block wall at the easterly property line and an increased landscaped setback area, to ensure that surrounding properties are not adversely affected. 2. Evidence presented at the public hearing indicates that the proposed facility has the potential to draw pests such as insects, mice and rats to the project area creating a vector control problem for surrounding properties in the vicinity of project site. 3. Evidence presented at the public hearing indicates that the proposed facility may generate an adverse amount of pollution from an over accumulation of trash and debris deposited on the roadways and properties surrounding the site from uncovered loads and illegal dumping. C. The use for which the CUE' is proposed is not consistent with the Hazards Management Element of the General Plan, which seeks "the reduction and eventual elimination...of all human related hazards to life and public safety," The proposed project is not in accordance with the Hazards Management Element of the General Plan for the following reasons: 1. Evidence presented at the public hearing indicates that the proposed facility will generate excessive traffic that will include large trash trucks and even larger trash transfer trucks that will be concentrated on the local circulation network generating an increase in hazards to public safety. 2. Evidence presented at the public hearing indicates that the proposed facility is located in close proximity to a large regional park facility that offers an extensive youth recreation program and is frequented by bicyclists and pedestrians leading to the potential for an increase in traffic hazards from conflicts with the concentrated truck traffic. 3. Evidence presented at the public hearing indicates that the excessive weight of the trucks concentrated on the local roadway network will lead to the accelerated dilapidation and degradation of the streets in closest proximity to the site leading to the potential for an increase in traffic accidents from the deteriorated streets. w..
